Court of Cassation: cashier who pockets prizes dismissed (Italia Oggi, November 13, 2013, page 25)

A cashier of the supermarket loses her job because she pockets the prizes for the clients. The dismissal is lawful, confirmed the Supreme Court, labor section, with sentence no. 24588/13, rejecting the remarks of the employee who claimed the lack of exhibition, in the work place, of the disciplinary code. Therefore, the dismissal would have been unlawful because she couldn’t be aware of the prohibition and of the disciplinary sanction. But the Court stated that the breach of the prohibition was proved and the employee was aware of the prohibition of using the card reserved to clients for the prizes collection, this entailing a serious breach of the basic obligation provided for by art. 2104, par. 2, of the Civil Code.
