{"id":960,"date":"2024-07-04T07:51:16","date_gmt":"2024-07-04T05:51:16","guid":{"rendered":"https:\/\/www.delucapartners.it\/aree-di-attivita\/whistleblowing-2\/"},"modified":"2026-02-03T10:53:10","modified_gmt":"2026-02-03T09:53:10","slug":"whistleblowing-2","status":"publish","type":"activity_areas","link":"https:\/\/www.delucapartners.it\/en\/areas-of-practice\/whistleblowing\/","title":{"rendered":"Whistleblowing"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">With Italian Legislative Decree no. 24 of 10 March 2023, published in the Italian Official Gazette no. 63 of 15 March 2023, the Italian legislature implemented Directive (EU) 2019\/1937 \u201c<em>on the<\/em> <em>protection of persons who report breaches of Union law and provisions concerning the protection of persons who report breaches of national laws<\/em>\u201d (\u201c<strong><em>Whistleblowing Directive<\/em><\/strong>\u201d).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>We support companies in complying with the new regulations<\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To support client companies, De Luca &amp; Partners has created a TASK FORCE offering the necessary <strong>legal support<\/strong> to its clients in adopting the necessary <strong>procedures<\/strong> to ensure corporate compliance with the regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De Luca &amp; Partners\u2019 focus team advises and supports clients in implementing whistleblowing systems that protect the confidentiality of whistleblowers and prohibit retaliation against them while simultaneously identifying conduct, actions or omissions that harm the organisation\u2019s interests or integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The task force also provides an <strong>ongoing monitoring<\/strong> service to ensure that any reports received by companies are properly addressed and handled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>De Luca &amp; Partners\u2019 operational support \u200b<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We help Client companies:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to identify, develop and approve appropriate <strong>procedures, policies and regulations governing reporting processes<\/strong>, including in light of privacy and cybersecurity aspects;<\/li>\n\n\n\n<li>to initiate, manage and conclude the necessary trade union consultation procedures taking into account the involvement of trade union representatives or organisations;<\/li>\n\n\n\n<li><strong>to activate internal <\/strong>reporting <strong>channels<\/strong>;<\/li>\n\n\n\n<li><strong>to ensure that there is protection and confidentiality for whistleblowers<\/strong>;<\/li>\n\n\n\n<li>to conduct impact assessments of personal data processing operations as part of whistleblowing activities as well as draft and update privacy documentation;<\/li>\n\n\n\n<li>to plan and regulating <strong>remedial actions <\/strong>in the event that there are reported breaches;<\/li>\n\n\n\n<li><strong>to inform and train stakeholders in a clear, transparent and easily understandable <\/strong>manner about the company\u2019s identified procedures and how the reporting channels work, as well as inform and train personnel involved on how to manage a report;<\/li>\n\n\n\n<li>to establish<strong>\u00a0systems for monitoring <\/strong><strong>and<\/strong><strong>\u00a0updating <\/strong>identified<strong> processes to <\/strong>ensure that whistleblowing management systems are consistently maintained over time;<\/li>\n\n\n\n<li>by acting as external recipients for reports;<\/li>\n\n\n\n<li>to conduct internal investigations in the event of reports;<\/li>\n\n\n\n<li>to conduct disciplinary proceedings.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>With Italian Legislative Decree no. 24 of 10 March 2023, published in the Italian Official Gazette no. 63 of 15 March 2023, the Italian legislature implemented Directive (EU) 2019\/1937 \u201con the protection of persons who report breaches of Union law and provisions concerning the protection of persons who report breaches of national laws\u201d (\u201cWhistleblowing Directive\u201d).
