{"id":21483,"date":"2019-12-02T11:36:00","date_gmt":"2019-12-02T10:36:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/subcontracting-the-general-indication-of-peaks-of-intense-activity-is-insufficient\/"},"modified":"2026-03-11T11:59:10","modified_gmt":"2026-03-11T10:59:10","slug":"subcontracting-the-general-indication-of-peaks-of-intense-activity-is-insufficient","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/subcontracting-the-general-indication-of-peaks-of-intense-activity-is-insufficient\/","title":{"rendered":"Subcontracting, the general indication of peaks of intense activity is insufficient (Il Quotidiano del Lavoro de Il Sole 24 Ore, 2 December 2019 &#8211; Vittorio De Luca, Antonella Iacobellis)"},"content":{"rendered":"\n<p>The\nCourt of Appeal, by order no. 28285 dated 4 November 2019, (i) established\nthat, in order to resort to labour-only subcontracting, it is necessary that\nthe factual elements in respect of which the court has the possibility of\nverifying the effectiveness of the grounds must be specified, given that the\nmere reference to &#8220;peaks of intense activity&#8221; and (ii) specified that\nthe collective agreement can extend but not include prohibitions in addition to\nthose stated in paragraph 5, Article 20, of Legislative Decree no. 276\/2003.\nThe legal case originates from an appeal filed by an employee at the Court of\nPescara against the supplier company and the user company, so that the\nunlawfulness of the subcontracting agreement could be ascertained and, as a\nresult, so that (i) the existence of a permanent employment contract with the\nuser company and (ii) the ordering of the latter to pay the salaries accrued\nfrom the termination of the contract, or from the time of formal notice of\ntermination, until the time of reinstatement, could also be ascertained. The\nregional Court of First Instance fully accepted the employee\u2019s requests,\nacknowledging the existence of an employment contract with the user company,\nwith the superior position &#8211; level B of the National Collective Bargaining\nAgreement applied, as technical assistant &#8211; and ordering the user company to\npay both the remuneration differences and compensation proportional to 6\nmonths\u2019 worth of salary, calculated on the basis of Article 32, paragraph 5, of\nLaw no. 183\/2010. However, the Court of Appeal of L&#8217;Aquila reformed the first\ninstance order, considering,<em> inter alia<\/em>, that \u2013 the reason for the\nemployee\u2019s employment contract was sufficiently specific; \u2013 the preliminary\nresults confirmed the intensification of the activity during the reference\nperiod; \u2013 there had been no breach of the collective discipline, given that\nLegislative Decree no. 276\/2003 did not require the collective employment\ncontract to identify prohibitions in addition to those specified in Article 20\nof said decree; \u2013 as provided for by Article 20, paragraph 4 of Legislative\nDecree no. 276\/2003, the existence of ordinary replacement organisational,\nproductive and technical reasons of the user to justify its use of\nsubcontracting was sufficient, given that it is not necessarily required that\nthe activity determined by the contract must be extraordinary and exceptional;\n\u2013 extensions based on the original reason for the subcontracting agreement were\nto be considered lawful. The employee filed an appeal with the Court of Appeal\nbased on two reasons: the first with which he reported the breach and false\napplication of Article 20, paragraph 4, of Article 21, paragraph 1, section c)\nand paragraph 4 of Article 27, paragraph 1, of Legislative Decree no. 276\/2003\nand the second with which he reported the breach and false application of the\nNational Collective Bargaining Agreement applied, as supplemented by Memorandum\nof Understanding dated 26.07.2007.
