Non per nulla, a seguito dell\u2019introduzione del D.Lgs. 81\/08, il legislatore ha arricchito il catalogo dei reati presupposto della responsabilit\u00e0 amministrativa degli enti, facendovi rientrare le ipotesi di omicidio colposo e lesioni gravi o gravissime commesse con violazione delle norme sulla tutela della salute e della sicurezza sul lavoro. Le sanzioni astrattamente configurabili evidenziano la funzione general preventiva sottesa alla volont\u00e0 del legislatore, prevedendo sanzioni sia interdittive sia pecuniarie per l\u2019impresa. Al fine di evitare il configurarsi delle fattispecie criminose suddette, il datore di lavoro deve far riferimento a quanto stabilito dall\u2019art. 30 D.Lgs. 81\/08, il quale prevede che il modello debba essere adottato ed efficacemente attuato, tenendo conto di determinati obblighi giuridici (sorveglianza sanitaria, rispetto standard tecnico-strutturali di legge circa impianti e attrezzature etc.).
