Among\nthe measures that have come one after another in these weeks, this is the right\ntime to make some remarks in light of the novelties introduced with Italian\nLegislative Decree no. 18\/2020 \u201cCura Italia\u201d, effective as of 17 March 2020.<\/p>\n\n\n\n
First\nof all, it should be noted that in terms of social safety nets, the redundancy\nscheme included in our legal system is certainly one of the most favorable if\ncompared with the main western countries and therefore a special law should not\nbe necessary except to offer coverage to companies excluded from its benefits\nat present.<\/p>\n\n\n\n
In\nterms of these companies, it has become very clear that the logic followed by\nthe 2014 legislation (Law no. 183\/14) for the reform of social safety nets\nbasically focused on the desire to take into \u201caccount the special natures of\nvarious manufacturing sectors\u201d, appears less and less adequate with the need to\nprovide companies with uniform instruments able to offer solutions and coverage\nfor systemic problems like the one generated by the most famous virus at\npresent.<\/p>\n\n\n\n
That\nsaid, we know that the Cura Italia Decree introduces extraordinary provisions\nfor access to social safety nets for companies forced to reduce or suspend work\ndue to the COVID-19 emergency.<\/p>\n\n\n\n
The\naforesaid Decree – among the multitude of included interventions – on one hand\nintroduces an exception to the redundancy scheme and on the other provides the\npossibility of easy access to the ordinary redundancy scheme and wage\nintegration fund.<\/p>\n\n\n\n
Basically,\nthe use of the ordinary redundancy scheme and wage integration fund has been\nsimplified, since a \u201cfast track\u201d welfare consultation needs to be performed,\nupon request of trade union organizations within 3 (three) days.<\/p>\n\n\n\n
This\nintroduced consultation represents something brand new, not just due to the\nshort, record-breaking deadline, but also due to the innovative \u201celectronic\u201d\nprocedures which the same urgent law allows and includes.<\/p>\n\n\n\n
We\nconfirm that the solutions proposed by the current government to make the\nintervention of social safety nets more effective and resolutive, and believe\nthat – once the emergency period is over – the law wants to introduce universal\ntype social safety nets, i.e. applicable to all workers, regardless of their\nsector, just like it did with unemployment benefits (so-called NASPI) in 2015.<\/p>\n","protected":false},"excerpt":{"rendered":"
