In particular, the Court of Cassation &#8211; excluding the reinstatement of the employee &#8211; ruled that the obligation of rep\u00eachage does not require the employer to relocate the employee to lower tasks in the workforce if there are no tasks compatible with the dismissed employee&#8217;s professional profile.<\/p>\n\n\n\n<p>The case originates from an appeal brought by an employee, who held the position of export salesman, who was dismissed following the cancellation of his position. Challenging the dismissal, the worker claimed that the company had not adequately explored all the possibilities of outplacement within the company, thus requesting reinstatement.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"16825\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/11\/shutterstock_1496256611-1024x681.jpg\" alt=\"\" class=\"wp-image-16825\"\/><\/figure>\n<\/figure>\n\n\n\n<p>In the course of the proceedings, the Court of First Instance had held that the dismissal was unlawful from a procedural point of view, and had also recognised that the rep\u00eachage obligation had not been complied with.
