{"id":21925,"date":"2025-06-06T10:52:17","date_gmt":"2025-06-06T08:52:17","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/addio-al-rito-fornero-ma-solo-per-le-cause-iniziate-dopo-il-28-febbraio-2023-modulo-24-contenzioso-lavoro-de-il-sole-24-ore-28-maggio-2025-vittorio-de-luca-alessandra-zilla-2\/"},"modified":"2026-03-11T11:18:33","modified_gmt":"2026-03-11T10:18:33","slug":"addio-al-rito-fornero-ma-solo-per-le-cause-iniziate-dopo-il-28-febbraio-2023-modulo-24-contenzioso-lavoro-de-il-sole-24-ore-28-maggio-2025-vittorio-de-luca-alessandra-zilla","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/addio-al-rito-fornero-ma-solo-per-le-cause-iniziate-dopo-il-28-febbraio-2023-modulo-24-contenzioso-lavoro-de-il-sole-24-ore-28-maggio-2025-vittorio-de-luca-alessandra-zilla\/","title":{"rendered":"Goodbye to the Fornero Rite, but only for lawsuits started after Feb. 28, 2023 (Guida al Lavoro of Il Sole 24 Ore, 28 May 2025 \u2013 Vittorio De Luca, Alessandra Zilla)"},"content":{"rendered":"\n<p>In the very recent ruling No. 11344 of April 30, 2025, the Supreme Court clarified that judicial proceedings introduced under the so-called Fornero Rite before February 28, 2023 continue to be governed, even in the appeal stages, by the provisions dictated by the same rite, although the same was repealed by the so-called <a href=\"https:\/\/www.delucapartners.it\/en\/insights\/normativa\/repeal-of-the-fornero-procedure-transitional-provisions\/\">Cartabia Reform<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Succession of procedural rules on dismissal appeals and transitional regime<\/strong><\/h2>\n\n\n\n<p>The so-called \u201cFornero rite\u201d had been introduced by Law No. 92\/2012 (Art. 1, paragraphs 47 &#8211; 69) to address the need to ensure celerity in the resolution of dismissal disputes.<\/p>\n\n\n\n<p>While the legislator&#8217;s intentions were shareable, from the first applications the genetic flaws of that normative translation had become apparent.<\/p>\n\n\n\n<p>In fact, the Fornero rite, applicable only to dismissals governed by Article 18 of the Workers&#8217; Statute, implied that the judicial claim could only concern the legitimacy of the dismissal and issues \u201cbased on the same constituent facts.\u201d This led, on the one hand, to interpretive doubts about the claims admissible under this rite and, on the other, to a fractioning of judicial claims related to the employment relationship, resulting in an inevitable proliferation of judicial litigation.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/04\/shutterstock_1060957841-1024x683.jpg\" alt=\"\" class=\"wp-image-20196\"\/><\/figure>\n\n\n\n<p>Reflection on the evident ineffectiveness of the Fornero rite, as to the possibility of explaining that prefigured deflative effect, had already led the legislature to its \u201capplicative downsizing\u201d by Legislative Decree No. 23\/2015, which excluded its application to dismissals subject to the so-called \u201cgrowing protections\u201d regime, for all employment relationships established since March 7, 2015.<\/p>\n\n\n\n<p>After all, the so-called.
