By way of <\/span>judgment No. 9467\/2016 <\/strong><\/span>the Court of Cassation has stated that the dismissal for justified objective grounds is lawful if the employer gives \u201c<\/span>evidence as to both the fact that the dismissal <\/em><\/span>may be specifically referred <\/strong><\/em><\/span>to initiatives related to <\/em><\/span>actual <\/strong><\/em><\/span>productive and organisational <\/em><\/span>reasons<\/strong><\/em><\/span>, and <\/em><\/span>as to the impossibility to use the worker for other jobs compatible with the held status, in connection <\/strong><\/em><\/span>with the <\/em><\/span>specific professional content <\/strong><\/em><\/span>of the activity to which the worker had been previously assigned<\/em><\/span>\u201d. The above since the employer <\/span>has no <\/strong><\/span>\u201c<\/span>obligation to offer all jobs to the worker<\/strong><\/em><\/span>, including those which are totally incompatible<\/em><\/span> with the previously carried out jobs<\/em><\/span>\u201d. In short, in the event of company reorganisation with a concomitant suppression of a certain position and in offering a different – and even lower – job to the worker concerned, the employer must in any event assess the uniformity and compatibility of the new tasks compared to those originally carried out.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
