{"id":22879,"date":"2016-05-26T22:00:00","date_gmt":"2016-05-26T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/court-of-cassation-the-repechage-obligation-does-not-impose-the-assignment-to-lower-jobs\/"},"modified":"2026-02-16T16:28:09","modified_gmt":"2026-02-16T15:28:09","slug":"court-of-cassation-the-repechage-obligation-does-not-impose-the-assignment-to-lower-jobs","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/giurisprudenza\/court-of-cassation-the-repechage-obligation-does-not-impose-the-assignment-to-lower-jobs\/","title":{"rendered":"Court of Cassation: the rep\u00eachage obligation does not impose the assignment to lower jobs"},"content":{"rendered":"\n<p align=\"justify\"><span lang=\"en-GB\">By way of <\/span><span lang=\"en-GB\"><strong>judgment No. 9467\/2016 <\/strong><\/span><span lang=\"en-GB\">the Court of Cassation has stated that the dismissal for justified objective grounds is lawful if the employer gives \u201c<\/span><span lang=\"en-GB\"><em>evidence as to both the fact that the dismissal <\/em><\/span><span lang=\"en-GB\"><em><strong>may be specifically referred <\/strong><\/em><\/span><span lang=\"en-GB\"><em>to initiatives related to <\/em><\/span><span lang=\"en-GB\"><em><strong>actual <\/strong><\/em><\/span><span lang=\"en-GB\"><em>productive and organisational <\/em><\/span><span lang=\"en-GB\"><em><strong>reasons<\/strong><\/em><\/span><span lang=\"en-GB\"><em>, and <\/em><\/span><span lang=\"en-GB\"><em><strong>as to the impossibility to use the worker for other jobs compatible with the held status, in connection <\/strong><\/em><\/span><span lang=\"en-GB\"><em>with the <\/em><\/span><span lang=\"en-GB\"><em><strong>specific professional content <\/strong><\/em><\/span><span lang=\"en-GB\"><em>of the activity to which the worker had been previously assigned<\/em><\/span><span lang=\"en-GB\">\u201d. The above since the employer <\/span><span lang=\"en-GB\"><strong>has no <\/strong><\/span><span lang=\"en-GB\">\u201c<\/span><span lang=\"en-GB\"><em><strong>obligation to offer all jobs to the worker<\/strong><\/em><\/span><span lang=\"en-GB\"><em>, including those which are totally incompatible<\/em><\/span> <span lang=\"en-GB\"><em>with the previously carried out jobs<\/em><\/span><span lang=\"en-GB\">\u201d.
