{"id":22993,"date":"2017-07-23T22:00:00","date_gmt":"2017-07-23T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/dismissal-due-to-the-suppression-of-a-post-through-a-different-division-of-duties-is-lawful\/"},"modified":"2026-02-16T16:10:32","modified_gmt":"2026-02-16T15:10:32","slug":"dismissal-due-to-the-suppression-of-a-post-through-a-different-division-of-duties-is-lawful","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/giurisprudenza\/dismissal-due-to-the-suppression-of-a-post-through-a-different-division-of-duties-is-lawful\/","title":{"rendered":"Dismissal due to the suppression of a post through a different division of duties is lawful"},"content":{"rendered":"\n<p style=\"text-align: justify;\">In its decision no. 14871 of 15 June 2017, the Court of Cassation referred to its own case-law orientation and confirmed that, within the sphere of a <strong>dismissal due to objective just cause<\/strong>, in relation to the <strong>suppression of a post<\/strong>, it is not necessary for all the <strong>duties<\/strong> previously assigned to the dismissed employee to be suppressed, but that they may be <strong>differently divided up and assigned<\/strong> according to the \u201c<em>entrepreneur\u2019s undeniable right of choice<\/em>\u201d. This was correct, in the opinion of the Court of Cassation, precisely because the notion of dismissal for objective just cause also includes the case of a company\u2019s <strong>reorganisation<\/strong> aimed at its <strong>more economical management<\/strong> as decided by the entrepreneur \u201c<em>not simply to increase its profits but also in order to deal with unfavourable conditions (that may not be merely of a contingent nature) that may have a decisive effect on normal production, thus creating the actual need to reduce costs<\/em>\u201d.
