{"id":24087,"date":"2016-05-26T22:00:00","date_gmt":"2016-05-26T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/the-interdepartmental-decree-on-performance-bonuses-and-the-sharing-into-the-companys-profits\/"},"modified":"2026-02-16T16:31:25","modified_gmt":"2026-02-16T15:31:25","slug":"the-interdepartmental-decree-on-performance-bonuses-and-the-sharing-into-the-companys-profits","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/prassi\/the-interdepartmental-decree-on-performance-bonuses-and-the-sharing-into-the-companys-profits\/","title":{"rendered":"The Interdepartmental Decree on performance bonuses and the sharing into the company&#8217;s profits"},"content":{"rendered":"\n<p align=\"justify\"><span lang=\"en-GB\">By way of the <\/span><span lang=\"en-GB\"><strong>publication <\/strong><\/span><span lang=\"en-GB\">of Interdepartmental Decree No. 1462\/2016 on the Ministry of Labour&#8217;s Website on 16 May 2016, <\/span><span lang=\"en-GB\"><strong>the concessions on performance bonuses and on the amounts paid to employees by way of sharing into the company&#8217;s profits introduced by 2016 Stability Law have become effective. <\/strong><\/span><span lang=\"en-GB\">The Decree at issue governs, amongst others, (i) the <\/span><span lang=\"en-GB\"><strong>criteria for checking and measuring the increases <\/strong><\/span><span lang=\"en-GB\">in productivity, profitability, quality, efficiency and innovation to which the agreements at company or territorial level link the payment of performance bonuses and <\/span><span lang=\"en-GB\"><strong>the achievement of which may be checked objectively <\/strong><\/span><span lang=\"en-GB\">by way of the relevant comparison with specially identified numerical indicators or the like, and (ii) the <\/span><span lang=\"en-GB\"><strong>criteria for identifying <\/strong><\/span><span lang=\"en-GB\">the <\/span><span lang=\"en-GB\"><strong>amounts paid by way of sharing into the company&#8217;s profits, <\/strong><\/span><span lang=\"en-GB\">by considering as such the profits distributed pursuant to section 2102 of the Italian Civil Code. For the purposes of applying the concession, the amounts paid must be foreseen within the scope of agreements at company level to be filed online with the Territorial Employment Department within 30 days as of the respective signature.
