{"id":24147,"date":"2018-01-28T23:00:00","date_gmt":"2018-01-28T22:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/an-intern-may-be-posted-at-another-employers-location\/"},"modified":"2026-02-16T16:14:14","modified_gmt":"2026-02-16T15:14:14","slug":"an-intern-may-be-posted-at-another-employers-location","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/prassi\/an-intern-may-be-posted-at-another-employers-location\/","title":{"rendered":"An intern may be posted at another employer&#8217;s location"},"content":{"rendered":"\n<p style=\"text-align: justify;\">The <strong>National Labour Inspectorate, <\/strong>with <strong>memorandum No. 290 dated 12 January 2018<\/strong>, published its opinion on the compatibility of training in an internship agreement with posting pursuant to article 30 of the <a href=\"http:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2003;276\">Legislative Decree No. 276\/2003<\/a>. On this matter, the Labour Inspectorate <strong>does not see reasons against <\/strong>the possibility of making use of <strong>posting<\/strong> in <strong>internship <\/strong>relationship, without prejudice to meeting the requirements of law. In particular, regarding the existence of <strong>interest of the posted party<\/strong>, upon the expressed <strong>establishment of the posting in the individual training plan <\/strong>of the worker and the presence of an adequate <strong>tutor<\/strong> made available by the employer. Regarding the latter, the Inspectorate, in recalling what had already been stated by the Ministry of Labour in the official memorandum <a href=\"http:\/\/www.dottrinalavoro.it\/notizie-c\/min-cir-402004-contratto-apprendistato\">No. 40\/2004<\/a>, noted that (i) whenever the company employs an adequate number of specialised employees, it is not relevant their location within the production unit where the interns operate and (ii) this is valid also for \u201c<em>remote<\/em>\u201d training and \u201c<em>tutoring<\/em>\u201d activities.
