{"id":24157,"date":"2018-05-01T22:00:00","date_gmt":"2018-05-01T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/the-guidelines-of-the-inl-on-the-supply-of-labour\/"},"modified":"2026-02-16T16:14:15","modified_gmt":"2026-02-16T15:14:15","slug":"the-guidelines-of-the-inl-on-the-supply-of-labour","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/prassi\/the-guidelines-of-the-inl-on-the-supply-of-labour\/","title":{"rendered":"The guidelines of the INL on the supply of labour"},"content":{"rendered":"\n<p style=\"text-align: justify;\">Through its circulars No. 6 and No. 7 of 2018, the <strong><em>Ispettorato nazionale del lavoro<\/em><\/strong> (namely, the national labour inspectorate or \u201cINL\u201d) has fixed the guidelines on the supply of labour, starting from the content of judgement No. 254\/2017 with which the Constitutional Court ruled on the scope of application of article 29 of Legislative Decree No. 276\/2003, by also extending it to sub-supply agreements. In particular the INL, <strong>with its circular No. 6\/2018<\/strong>, has given operational instructions to the investigators, by mentioning that all those situations in which there is a \u201c<strong>dissociation<\/strong>\u201d <strong>between the employer and the user <\/strong>of the work, including the cases <strong>of relations between consortium and consortium companies<\/strong>, are worth being inspected. <strong>With its circular No. 7\/2018<\/strong> the INL, instead, has faced the issue of the <strong>network agreements<\/strong>, mentioning the formal elements to be checked in case of any inspection, such as: (i) <strong>the existence <\/strong>of an agreement; (ii) <strong>the filing <\/strong>of the agreement with the Companies\u2019 Register; (iii) reference in the agreement as to <strong>any possible co-employment <\/strong>of the employment relationship.
