This is provided\nthat the companies concerned are not RSAs or RSUs or, if incorporated, the\nattempt to reach agreement has been unsuccessful.<\/p>\n\n\n\n<p><strong>The\nfacts&nbsp; <\/strong><strong><\/strong><\/p>\n\n\n\n<p>The INL&#8217;s favourable opinion came following the\nrequest for authorisation made by certain companies, carrying out transport and\ndelivery services operators for a company, to be able to install, on the\nsmartphone assigned to delivery workers, a special order management application\ndeveloped by the client company itself but exclusively owned and available to them.\n<\/p>\n\n\n\n<p><strong>The\nopinion of the INL&nbsp; <\/strong><strong><\/strong><\/p>\n\n\n\n<p>According to the INL, the installation of this\napplication on Drivers&#8217; smartphones does not breach Article 4 of the Workers&#8217;\nStatute.<\/p>\n\n\n\n<p>Firstly, according to the INL, there are the specific\n&#8220;<strong><em>organisational and production needs<\/em><\/strong>&#8221; required by the\narticles of association, so that the application:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>allows\nDrivers to view the list of deliveries to be made during the working day to\ncustomers of the client company;<\/li><li>allows\nthe employer of the Drivers and the client company to know, in real time, the\ncorrectness and timeliness of deliveries;<\/li><li>monitors,\nin real time, the remaining deliveries\/receipts during the day;<\/li><li>acquires\nreal and clear evidence in the event of a dispute with the client.<\/li><\/ul>\n\n\n\n<p>Again, according to the INL, the application is also\nfunctional to the need for &#8220;<strong><em>occupational safety<\/em><\/strong>&#8220;, given\nthat it:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>facilitates\nthe finding of the courier in case of emergency and that<\/li><li>drivers\ncan inform their employer of any faults in the vehicle and\/or ask for help in\nthe event of accident or illness.<\/li><\/ul>\n\n\n\n<p>In addition, the INL pointed out that the device does\nnot allow for the continuous geolocation of the worker. In fact, it is\nactivated only at the time of delivery of the goods and, again, in the event of\na request for help from the same worker and is then deactivated again\nimmediately afterwards.<\/p>\n\n\n\n<p>In giving its go-ahead, the INL has dictated a number\nof conditions, including the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the company must provide,\npursuant to Article 4, paragraph 3, of the Workers&#8217; Statute, an appropriate\nwritten information to the Drivers regarding the operating procedures, the\nperformance of checks and the purposes justifying the relative authorisation;<\/li><li>the\ninstallation and use of the application, as well as the processing, storage and\nprotection of data and information gathered must be carried out in compliance\nwith the provisions on the protection of personal data; <\/li><li>access\nto the data gathered by the application, allowed only for the purposes\nrepresented above, by the persons in charge, must be traced by means of special\nfunctionalities that&nbsp; for knowledge of\nwhich data is accessed and the related reason; &#8220;access logs&#8221; must be\nkept for a reasonable period; <\/li><\/ul>\n\n\n\n<p>\n\n\n\n\n\ndata must be retained\nfor a period not exceeding the time strictly necessary for the purposes for\nwhich it was collected.\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Central Directorate of Supervision, Legal Affairs and Litigation of the National Labour Inspectorate (&#8220;INL&#8220;), with note no. 9728 dated November 12, 2019, authorised the installation of an application on smartphones assigned to so-called Drivers, allowing for their geolocation during the delivery of goods.
