On 6 September 2019, the\nEuropean Data Protection Board (“EDPB<\/strong>“)\ncompleted its public consultation on the document containing the draft of the\nforthcoming Guidelines 3\/2019 concerning\nvideo surveillance <\/strong>(“Guidelines\n3\/2019 on processing of personal data through video devices<\/em>“). <\/em><\/strong><\/p>\n\n\n\n

The images and audio tracks\nthat are processed through the use of video surveillance systems, fall under\nthe definition of “personal data” as they enable individuals to be\nidentified, be it directly or indirectly. The processing of such information\nmust therefore fully comply with EU Regulation 2016\/679 – GDPR – on the\nprotection of personal data and (in accordance with Italian law) and\nLegislative Decree 196\/2003 as amended by Legislative Decree 101\/2018\ncontaining the rules for adapting national legislation to the said Regulation. <\/p>\n\n\n\n

The aim that the European\nCommittee intends to achieve with the issuance of these new Guidelines, is to\nensure a uniform application of the legislation on video surveillance within\nall Member States of the European Union.<\/p>\n\n\n\n

In view of the foregoing, it\nmust first be made clear that the clarifications given in the draft concerning\nthe legal basis on which the installation of the system is based are of\nfundamental importance.
\nIn principle, it is possible that all the conditions for lawfulness set forth\nin Article 6, paragraph  1), of the GDPR\nare met, even if those most applied in practice are the legitimate interest\nthat the Data Controller needs to pursue (Article. 6, paragraph 1),\nsection f), GDPR) or the performance of a task in the public interest (Article\n6, paragraph 1), section e), GDPR). <\/p>\n\n\n\n

The European Committee\nclarifies that the Data Controller must\nspecify in detail both the legal basis on which the data processing carried out\nis based and the detail of the purposes pursued. <\/strong>A system based on\n“security” in its simplest and most general sense is no longer a\nsufficiently detailed purpose.<\/p>\n\n\n\n

Another important\nclarification concerns filming based on legitimate interest. Data processing is\nconsidered lawful only if this legal\nbasis remains real, current and demonstrable at all times<\/strong>. <\/p>\n\n\n\n

The Italian Data Protection\nAuthority has, on several occasions, recommended that Data Controllers use the\nvideo surveillance tool in a proportionate and non-excessive manner and this\napproach can be found in the draft of the forthcoming Guidelines. Before\nproceeding with the installation of such systems, in fact, the Data Controller\nmust use other tools (such as, for example, support by appropriate security\nstaff, the provision of remote-controlled gates or adequate lighting) and demonstrate the effective need for the\nadoption of a video surveillance system. <\/strong>This, paying particular attention\nto limiting and defining, both temporally and geographically, filming in order\nto constantly respect the principle of minimisation of personal data pursuant\nto Article 5, point 1, section c) of the GDPR.<\/p>\n\n\n\n

Each Data Controller is\nrequired to balance the interests involved<\/strong>\nby analysing, on a case-by-case basis, the legitimate interests of the Data\nController, on the one hand, and the fundamental rights and freedoms of the\ndata subjects on the other. <\/p>\n\n\n\n

In view of the above, the\nEDPB is awaiting the publication of the final text of the Guidelines, which are\nnot only the first document to apply the principles of the GDPR to data\nprocessing carried out by video filming, but also, by national law, the first\nnew document on the subject after the “Provision\non video surveillance<\/em>” issued by the Italian Data Protection Authority\non 8 April 2010. <\/p>\n","protected":false},"excerpt":{"rendered":"
