{"id":25388,"date":"2024-05-29T12:39:56","date_gmt":"2024-05-29T10:39:56","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/lonere-della-prova-relativo-al-pagamento-delle-retribuzioni-e-a-carico-del-datore-di-lavoro-2\/"},"modified":"2026-04-08T14:16:59","modified_gmt":"2026-04-08T12:16:59","slug":"lonere-della-prova-relativo-al-pagamento-delle-retribuzioni-e-a-carico-del-datore-di-lavoro","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/news\/employer-bears-burden-of-proof-of-payment-of-remuneration\/","title":{"rendered":"Employer bears burden of proof of payment of remuneration"},"content":{"rendered":"\n<p>By order no. 10663 of 19 April 2024, the Italian Court of Cassation stated that the employer bears the burden of proof in proving that remuneration has been properly paid.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The facts of the case<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>The worker filed an application for summary judgment to obtain an order against the company to pay the amount indicated in the November 2015 pay slip.<\/p>\n\n\n\n<p>In the first instance, the first instance Court found that the payment was due to the worker.<\/p>\n\n\n\n<p>The company appealed to the Court of Appeal. The Court of Appeal upheld the first instance decision, ruling that the employer had not discharged its burden of proof relating to proving in court that the sum had been paid.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Italian Court of Cassation\u2019s decision<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>The Italian Court of Cassation \u2013 confirming the Court of Appeal decision \u2013 preliminarily noted that, once the existence of an employment relationship has been ascertained, the employer is under a strict duty of proof to establish that the remuneration has been paid. The employer can do this by means of the normal documentation i.e., regulatory pay slips bearing the worker\u2019s signature.
