{"id":25472,"date":"2024-09-19T14:54:46","date_gmt":"2024-09-19T12:54:46","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/in-vigore-il-decreto-salva-infrazioni-principali-modifiche-sulla-disciplina-dei-contratti-a-termine-nel-settore-privato-2\/"},"modified":"2026-02-16T16:21:30","modified_gmt":"2026-02-16T15:21:30","slug":"in-vigore-il-decreto-salva-infrazioni-principali-modifiche-sulla-disciplina-dei-contratti-a-termine-nel-settore-privato","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/en\/insights\/normativa\/the-salva-infrazioni-decree-is-in-force-main-changes-in-the-regulation-of-fixed-term-contracts-in-the-private-sector\/","title":{"rendered":"The \u201cSalva Infrazioni\u201d decree is in force \u2013 Main changes in the regulation of fixed-term contracts in the private sector"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2024\/06\/shutterstock_791765614-1024x683.jpg\" alt=\"\" class=\"wp-image-18763\"\/><\/figure>\n\n\n\n<p>On 16 September was published in the Official Gazette the Decree-Law no. 131\/2024 (i.e. \u201c<strong><em>Decreto Salva Infrazioni<\/em><\/strong><em>\u201d) &#8211; <\/em>in force since <strong>17 September &#8211; <\/strong>which also intervened on the regulation of fixed-term contracts through which the European Union requested Italy to align Italian legislation with EU Directive 1999\/70\/EC on fixed-term work.<\/p>\n\n\n\n<p>The \u201c<em>Salva Infrazioni<\/em>\u201d decree amended Article 28, paragraphs 2 and 3 of Legislative Decree No. 81\/2015 (i.e. \u201cJobs Act\u201d), introducing significant changes regarding the compensation indemnity for damages in case of fixed-term contracts declared unlawful.&nbsp;<\/p>\n\n\n\n<p><strong>Pre-existing regulation:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>In cases of transformation of a fixed-term contract into an open-ended contract, the employee is entitled to a lump sum indemnity ranging from 2.5 to 12-months\u2019 salary of the last reference salary for calculating severance pay.<\/li>\n<\/ul>\n\n\n\n<p>The maximum limit of the indemnity is reduced to <strong>6 months<\/strong>\u2019 salary in the case of collective agreements that provide for procedures to stabilize fixed-term workers.<\/p>\n\n\n\n<p>Amendments introduced by Decree-Law No. 131\/2024:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Decree gives to the judge power to set compensation indemnity exceeding 12-months\u2019 salary in cases of unlawful fixed-term contracts,<\/li>\n\n\n\n<li>Paragraph 3, which allowed the limit of the indemnity of the 6 months\u2019 salary, is abolished.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>On 16 September was published in the Official Gazette the Decree-Law no. 131\/2024 (i.e. \u201cDecreto Salva Infrazioni\u201d) &#8211; in force since 17 September &#8211; which also intervened on the regulation of fixed-term contracts through which the European Union requested Italy to align Italian legislation with EU Directive 1999\/70\/EC on fixed-term work.
