They concluded that the employee\u2019s behavior had irreparably damaged the trust necessary for the employer-employee relationship.<\/p>\n\n\n\n<p>The Court of Appeal specifically found that the employee\u2019s actions \u00ab<em>went beyond the formal boundaries of the right to criticize\u00bb<\/em> thus justifying the dismissal for just cause.<\/p>\n\n\n\n<p>Additionally, when evaluating the legitimacy of the dismissal, the Court of Appeal stated that \u00ab<em>the e-mails sent from the company\u2019s account and the posts on Facebook, marked by bitterness and acrimony and filled with vulgar and offensive language, clearly showed an intent to personally and professionally offend and humiliate her superiors, undermining any legitimate claim of protecting the company\u2019s interests\u00bb<\/em>. The Second &#8211; Instance Court further highlighted that the employee\u2019s conduct was not an expression of her right to criticize, but rather an attempt to harm the company\u2019s reputation by mocking its leadership and suggesting unfounded corruption allegations.<\/p>\n\n\n\n<p>The employee challenged the Court of Appeal\u2019s decision by appealing to the Italian Supreme Court, raising several grounds for the appeal.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"20073\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/02\/smart-working-shutterstock_1690108918-1024x683.jpg\" alt=\"\" class=\"wp-image-20073\"\/><\/figure>\n<\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Supreme Court\u2019s decision<\/strong><\/h2>\n\n\n\n<p>The Italian Supreme Court upheld the decision of the Court of Appeal, ruling that defamatory conduct on social media can indeed constitute just cause for dismissal, as it undermines the trust relationship between the employee and employer.
