MINISTRY OF LABOUR: CLARIFICATION ON THE NEW AMOUNTS OF PENALTIES PROVIDED FOR BY THE LAW DECREE NO. 145/2013 (IL SOLE 24 ORE, DECEMBER 31, 2013, PAGE 20)

The General Directorate for Inspection Activities of the Ministry of Labour and Welfare State, with the note of December 27, 2013, provided clarification on the application of the new administrative penalties provided by the Law Decree no. 145/2013 (so-called “Destination Italy”), in force since December 24, 2013. In particular, the note stated that the amounts to be paid for revoking the business activity suspension (now amounting to € 1,950 for the suspension of irregular employment and to € 3,250 for the suspension for serious and repeated violations health and safety protection at work) will apply to requests for revocation made by December 24, 2013, even if concerning acts performed before that date. With reference to irregular employment (so called “under the table work”), breaches of maximum average working time and of daily and weekly breaks put in place by December 24, the Ministry stated the possibility of postponing the notification of the relevant minutes after so called “Destination Italy” Decree comes into force. The Ministry also stated that these violations, if made before December 24, are subject to the penalty rules previously in force.
