In its Judgment No. 20949 of 3 October 2014, the Supreme Court of Cassation dismissed an appeal brought by a worker who sought classification as a manager, together with the corresponding pay difference. In so doing, it upheld the ruling of the Court of Appeal of Perugia, holding that in order to be attributed to the manager category, the worker must prove that such recognition is due as a result of a wide range of discretion available to him to make decisions capable of directing and influencing business performance and that he is bound only by the general guidelines of the business owner.
