Une r\u00e9glementation nationale pr\u00e9voyant une perte automatique du droit aux cong\u00e9s pay\u00e9s annuels, non subordonn\u00e9e au contr\u00f4le pr\u00e9alable de la possibilit\u00e9 effective pour le travailleur d\u2019exercer ce droit, n\u2019est pas compatible avec l\u2019art. 7 de cette directive. En effet, le travailleur doit \u00eatre consid\u00e9r\u00e9 comme la partie faible du contrat de travail. Il est donc n\u00e9cessaire d\u2019emp\u00eacher l\u2019employeur de disposer de la facult\u00e9 de lui imposer une restriction de ses droits&nbsp;\u00bb.<\/p>\n\n\n\n<p>Par cons\u00e9quent, le non versement d\u2019une indemnit\u00e9 financi\u00e8re pour les cong\u00e9s annuels non utilis\u00e9s au moment de la cessation du contrat de travail aurait viol\u00e9 non seulement l\u2019art. 7 \u00ab Cong\u00e9s annuels \u00bb de la directive n\u00b0 2003\/88 selon lequel&nbsp;: \u00ab 1. Les \u00c9tats membres prennent les mesures n\u00e9cessaires afin que chaque travailleur jouisse de cong\u00e9s pay\u00e9s annuels d\u2019au moins 4 semaines, en fonction des conditions d\u2019obtention et de concession pr\u00e9vues par les l\u00e9gislations et\/ou les pratiques nationales. 2. La p\u00e9riode minimum de cong\u00e9s pay\u00e9s annuels ne peut \u00eatre remplac\u00e9e par une indemnit\u00e9 financi\u00e8re, sauf en cas de fin du contrat de travail. \u00bb ;<\/p>\n\n\n\n<p>mais aussi l\u2019art. 36 de la Constitution : \u00ab Le travailleur a droit \u00e0 une r\u00e9mun\u00e9ration proportionn\u00e9e \u00e0 la quantit\u00e9 et \u00e0 la qualit\u00e9 de son travail et dans tous les cas suffisante pour garantir, \u00e0 lui-m\u00eame et \u00e0 sa famille, une existence libre et digne. La dur\u00e9e maximum de la journ\u00e9e de travail est fix\u00e9e par la loi.
