{"id":25717,"date":"2020-10-16T13:08:00","date_gmt":"2020-10-16T11:08:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-changement-de-marche-et-le-licenciement-en-temps-de-covid-19\/"},"modified":"2026-02-16T16:33:03","modified_gmt":"2026-02-16T15:33:03","slug":"le-changement-de-marche-et-le-licenciement-en-temps-de-covid-19","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/publications-2-fr\/le-changement-de-marche-et-le-licenciement-en-temps-de-covid-19\/","title":{"rendered":"Le changement de march\u00e9 et le licenciement en temps de Covid-19 (Guide en mati\u00e8re de travail de Il Sole 24 Ore, 16 octobre 2020 \u2013 Vittorio De Luca et Antonella Iacobellis)"},"content":{"rendered":"\n<p>Face \u00e0 la crise sanitaire li\u00e9e \u00e0 la pand\u00e9mie en cours, qui continue \u00e0 frapper tout notre pays, le L\u00e9gislateur et le Gouvernement ont voulu introduire des dispositions visant sauvegarder les emplois, en permettant l\u2019utilisation du ch\u00f4mage partiel et en imposant l\u2019interdiction du licenciement pour motif \u00e9conomique objectif conform\u00e9ment \u00e0 l\u2019art. 3 de la Loi n\u00b0 604\/1966 et du licenciement collectif conform\u00e9ment \u00e0 la Loi n\u00b0 223\/1991, exception faite des hypoth\u00e8ses ci-dessous :<\/p>\n\n\n\n<p>cessation d\u00e9finitive de l\u2019activit\u00e9 de l\u2019entreprise, avec liquidation de la soci\u00e9t\u00e9 (NB : la fermeture d\u2019une unit\u00e9 de production en soi n\u2019entra\u00eene pas la suspension du blocage)&nbsp;;<\/p>\n\n\n\n<p>accord collectif d\u2019entreprise avec les organisations syndicales comparativement les plus repr\u00e9sentatives au niveau national, avec une prime en cas de r\u00e9siliation du contrat pour les salari\u00e9s qui y adh\u00e8rent, auxquels on reconna\u00eet le droit aux indemnit\u00e9s de ch\u00f4mage (NASPI), bien que s\u2019agissant d\u2019une r\u00e9siliation consensuelle (il semble que les unit\u00e9s territoriales ou d\u2019entreprise seraient exclues) ;<\/p>\n\n\n\n<p>faillite sans aucun exercice provisoire de l\u2019activit\u00e9, avec cessation totale de celle-ci (NB : au cas o\u00f9 l\u2019exercice provisoire de l\u2019activit\u00e9 serait pr\u00e9vu pour une branche de l\u2019entreprise, les secteurs non touch\u00e9s par la faillite resteront exclus).<\/p>\n\n\n\n<p>Concernant le cas d\u2019esp\u00e8ce examin\u00e9, une att\u00e9nuation suppl\u00e9mentaire de l\u2019interdiction de licenciement a \u00e9t\u00e9 introduite, applicable quelle que soit la dimension de la soci\u00e9t\u00e9 employeur. La conversion du D.L. n\u00b0 18\/2020, par la Loi n\u00b0 27\/2020, a en effet modifi\u00e9 l\u2019art. 46, en mati\u00e8re de suspension des licenciements, selon lequel la suspension des proc\u00e9dures collectives de r\u00e9duction du personnel et de celles dues \u00e0 des licenciements pour motif \u00e9conomique objectif selon l\u2019art. 3 de la loi n\u00b0 604\/1966 ne s\u2019applique pas dans les \u00ab cas o\u00f9 le personnel concern\u00e9 par le licenciement, d\u00e9j\u00e0 employ\u00e9 dans le cadre du march\u00e9, est r\u00e9embauch\u00e9 suite \u00e0 l\u2019entr\u00e9e d\u2019un nouvel adjudicataire en vertu de la loi, d\u2019une convention collective nationale du travail ou d\u2019une clause du contrat de march\u00e9. \u00bb<\/p>\n\n\n\n<p>Source
