(Il Quotidiano del Lavoro de Il Sole 24 Ore, 4 mai 2020 \u2013 Vittorio De Luca, Antonella Iacobellis)"},"content":{"rendered":"\n<p>Les mesures d\u2019urgence prises par le gouvernement italien pour g\u00e9rer la crise en cours li\u00e9e \u00e0 la pand\u00e9mie de Covid-19 ont \u00e9galement, de facto, attribu\u00e9 au t\u00e9l\u00e9travail une fonction d\u2019instrument de limitation de la contamination et celui-ci devient ainsi une mesure de protection de la sant\u00e9 des travailleurs.<\/p>\n\n\n\n<p>En effet, le t\u00e9l\u00e9travail est une organisation qui tout en assurant la continuit\u00e9 de la prestation permet, en diminuant sensiblement les entr\u00e9es et la fr\u00e9quentation des locaux de la soci\u00e9t\u00e9, de r\u00e9duire les contacts entre les personnes et, en cons\u00e9quence, les risques de contamination.<\/p>\n\n\n\n<p>S\u2019il est vrai que l\u2019on ne peut pas parler d\u2019un droit du salari\u00e9 au t\u00e9l\u00e9travail, il est \u00e9galement vrai que l\u2019on ne peut pas parler d\u2019une simple facult\u00e9, pour l\u2019employeur, de faire travailler ses salari\u00e9s \u00e0 distance en p\u00e9riode de COVID19.<\/p>\n\n\n\n<p>Le Tribunal de Grosseto (section travail, ordonnance du 23 avril 2020 ), affirme que&nbsp;: \u00ab&nbsp;Dans ce contexte, le recours au t\u00e9l\u00e9travail r\u00e9gi, \u00e0 titre g\u00e9n\u00e9ral par la loi du 22 mai 2017, n\u00b0 81, a \u00e9t\u00e9 consid\u00e9r\u00e9 comme une priorit\u00e9. Pour des raisons \u00e9videntes, cette organisation du travail ne peut, ni ne pouvait, \u00eatre mise en place de fa\u00e7on g\u00e9n\u00e9ralis\u00e9e&nbsp;; elle a n\u00e9anmoins \u00e9t\u00e9 \u00e0 plusieurs reprises et fortement recommand\u00e9e, voire consid\u00e9r\u00e9e comme une organisation ordinaire du travail dans les entreprises su secteur public (cfr. art. 87, du d\u00e9cret-loi 18\/2020).
