Il s&rsquo;ensuit que le licenciement d&rsquo;un salari\u00e9 qui a d\u00e9pass\u00e9 sa p\u00e9riode de cong\u00e9s maladie dans de telles circonstances est licite.<\/p>\n\n\n\n<p>C&rsquo;est ce qu&rsquo;a affirm\u00e9 le Tribunal de Foggia par ordonnance du 17 juillet 2021, qui, appel\u00e9 \u00e0 se prononcer sur la validit\u00e9 d&rsquo;un licenciement pour d\u00e9passement de la p\u00e9riode de cong\u00e9s maladie, a d\u00e9clar\u00e9 que m\u00eame si l\u2019indemnit\u00e9 de compl\u00e9ment de salaire remplace, en cas de maladie, l&rsquo;indemnit\u00e9 journali\u00e8re correspondante, l&#8217;employeur ne peut pas modifier de mani\u00e8re autonome le motif de l&rsquo;absence du salari\u00e9, avec pour cons\u00e9quence que la p\u00e9riode de cong\u00e9s maladie en cas de maladie certifi\u00e9e continue \u00e0 courir jusqu&rsquo;\u00e0 ce que le salari\u00e9 demande la modification de l&rsquo;attribution de son absence du travail.<\/p>\n\n\n\n<p>En particulier, en l&rsquo;esp\u00e8ce, un salari\u00e9 a \u00e9t\u00e9 licenci\u00e9 pour avoir b\u00e9n\u00e9fici\u00e9 d&rsquo;une p\u00e9riode totale de 430 jours de cong\u00e9s maladie par rapport aux 420 jours pr\u00e9vus par la convention collective appliqu\u00e9e \u00e0 la relation de travail. Le salari\u00e9 a donc saisi la justice pour demander la constatation de l&rsquo;ill\u00e9galit\u00e9 de la mesure d&rsquo;expulsion, en faisant valoir qu&rsquo;il avait \u00e9t\u00e9 plac\u00e9, comme tous les autres salari\u00e9s de la soci\u00e9t\u00e9 qui l\u2019employait en ch\u00f4mage partiel ordinaire pour cause de Covid-19, ce qui avait remplac\u00e9, \u00e0 tous les \u00e9gards, la p\u00e9riode de cong\u00e9 de maladie dont il b\u00e9n\u00e9ficiait. A l&rsquo;appui de son argument, le salari\u00e9 invoque l&rsquo;art. 3, alin\u00e9a 7, du D\u00e9cret-loi n\u00b0 148\/2015, ainsi que la circulaire INPS (Institut National de Pr\u00e9voyance Sociale) n\u00b0 197\/2015, selon laquelle \u00ab <em>en cas de maladie, l&rsquo;indemnit\u00e9 de compl\u00e9ment de salaire remplace l&rsquo;indemnit\u00e9 journali\u00e8re de maladie ainsi que l&rsquo;\u00e9ventuelle indemnit\u00e9 pr\u00e9vue contractuellement<\/em> \u00bb. Le Tribunal a rejet\u00e9 le pourvoi &#8211; en se r\u00e9f\u00e9rant aux arguments exprim\u00e9s par le Tribunal de Pesaro dans son jugement n\u00b0 16\/2021 \u2013 a soulign\u00e9 qu\u2019avec le susdit art. 3, alin\u00e9a 7, du D\u00e9cret-loi n\u00b0 148\/2015, Le L\u00e9gislateur a seulement voulu pr\u00e9voir une attribution diff\u00e9rente de l&rsquo;avantage \u00e9conomique re\u00e7u par le salari\u00e9 en cas d&rsquo;utilisation d&rsquo;une p\u00e9riode de compl\u00e9ment de salaire, qui reste, en tout \u00e9tat de cause, \u00e0 la charge de l&rsquo;INPS (comme en cas de maladie), ne souhaitant pas intervenir sur la cause de l&rsquo;absence, qui rel\u00e8ve plut\u00f4t de la relation priv\u00e9e entre salari\u00e9 et employeur. Cette attribution diff\u00e9rente n&rsquo;a donc rien \u00e0 voir avec le cong\u00e9 maladie et avec le motif de la suspension du travail.
