Notamment, la Cour de Cassation a confirm\u00e9 que toutes les donn\u00e9es contenues dans l\u2019ordinateur assign\u00e9 au salari\u00e9 appartiennent \u00e0 l\u2019entreprise et que l\u2019employeur, dans le respect des devoirs de correction, de pertinence et de non-exc\u00e8s, a la facult\u00e9 d\u2019acqu\u00e9rir et d\u2019utiliser les donn\u00e9es qui y sont contenues \u00e0 des fins disciplinaires et d\u00e9fensives, sans que cela ne constitue en soi une violation de la r\u00e9glementation sur les donn\u00e9es personnelles. Au fil du temps, suivant l\u2019\u00e9volution de la r\u00e9glementation en mati\u00e8re de protection des donn\u00e9es personnelles, la Jurisprudence s\u2019est \u00e0 plusieurs reprises prononc\u00e9e sur ce sujet. On peut donc aujourd\u2019hui indiquer les principes de base sur lesquels se fonde le point d\u2019\u00e9quilibre entre la facult\u00e9 de l\u2019employeur et le droit \u00e0 la confidentialit\u00e9 des salari\u00e9s.<\/p>\n\n\n\n<p>\u00c0 ce sujet, la r\u00e8gle principale est, comme on le sait, l\u2019article 4 du Statut des Travailleurs (Loi 300\/1970) ; dans sa version originale, c\u2019est-\u00e0-dire avant la modification apport\u00e9e par le&nbsp;<em>Jobs Act<\/em>&nbsp;(le D\u00e9cret l\u00e9gislatif 151\/2015), la r\u00e9glementation pr\u00e9voyait deux niveaux de protection de la vie priv\u00e9e du travailleur \u00ab<em>un au moyen de l\u2019interdiction absolue de l\u2019utilisation d\u2019\u00e9quipements audiovisuels et autres appareils \u00e0 des fins de contr\u00f4le \u00e0 distance de l\u2019activit\u00e9 des travailleurs non justifi\u00e9e par des raisons inh\u00e9rentes \u00e0 l\u2019entreprise ; l\u2019autre, affaibli, au cas o\u00f9 les raisons du contr\u00f4le auraient \u00e9t\u00e9 li\u00e9es \u00e0 des exigences objectives de l\u2019entreprise, sous r\u00e9serve de la r\u00e9alisation de ce contr\u00f4le dans le respect de \u00ab proc\u00e9dures de garantie \u00bb d\u00e9termin\u00e9es<\/em>\u201d (en ce sens, Cass. 22 septembre 2021, n\u00b0 25732). Apr\u00e8s la r\u00e9forme r\u00e9alis\u00e9e par le Jobs Act, le nouvel article 4 a repris l\u2019interdiction d\u2019utiliser des \u00e9quipements audiovisuels et autres instruments entra\u00eenant la possibilit\u00e9 de contr\u00f4ler \u00e0 distance l\u2019activit\u00e9 des travailleurs. La r\u00e9glementation a ensuite confirm\u00e9 la d\u00e9rogation g\u00e9n\u00e9rale \u00e0 cette interdiction qui, en pr\u00e9sence d\u2019un accord syndical ou, \u00e0 titre subordonn\u00e9, d\u2019autorisation de l\u2019Inspection du Travail, justifierait l\u2019installation d\u2019\u00e9quipements et d\u2019instruments permettant le contr\u00f4le \u00e0 distance, \u00e0 la condition qu\u2019il soit motiv\u00e9 par (i) des exigences li\u00e9es \u00e0 l\u2019organisation et \u00e0 la production, (ii) la d\u00e9fense de la s\u00e9curit\u00e9 sur le lieu de travail et (iii) la protection du capital de l\u2019entreprise.&nbsp;<\/p>\n\n\n\n<p>Une importante nouveaut\u00e9 (mais d\u2019un impact r\u00e9duit en pratique et dans la Jurisprudence par une approche nettement protectrice) a en revanche \u00e9t\u00e9 introduite par le deuxi\u00e8me alin\u00e9a de la nouvelle r\u00e9glementation, qui pr\u00e9voit que l\u2019interdiction g\u00e9n\u00e9rale (avec obligation d\u2019accord ou d\u2019autorisation) ne s\u2019applique pas aux instruments utilis\u00e9s par les travailleurs pour fournir leur prestation de travail et aux instruments d\u2019enregistrement des acc\u00e8s et des pr\u00e9sences.<\/p>\n\n\n\n<p>Sous r\u00e9serve de ce qui pr\u00e9c\u00e8de, les informations collect\u00e9es au moyen de contr\u00f4les l\u00e9gaux, toujours au sens de l\u2019art. 4 du Statut des Travailleurs, peuvent \u00eatre utilis\u00e9es \u00e0 toutes les fins li\u00e9es au contrat de travail (donc aussi \u00e0 des fins disciplinaires), \u00e0 certaines conditions, c\u2019est-\u00e0-dire : a) que le travailleur ait \u00e9t\u00e9 inform\u00e9 de mani\u00e8re appropri\u00e9e sur les modalit\u00e9s d\u2019utilisation de ces instruments et de r\u00e9alisation des contr\u00f4les et b) qu\u2019aient \u00e9t\u00e9 respect\u00e9es les dispositions vis\u00e9es par la r\u00e9glementation en mati\u00e8re de protection des donn\u00e9es personnelles (actuellement repr\u00e9sent\u00e9e par le R\u00e8glement (UE) 2016\/679 et par le D\u00e9cret L\u00e9gislatif n\u00b0 101\/2018.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur&nbsp;<a href=\"https:\/\/ntplusdiritto.ilsole24ore.com\/art\/il-punto-controlli-datoriali-provvedimenti-disciplinari-e-diritto-riservatezza-AEBjAo3\"><strong>Norme &amp; Tributi Plus Diritto<\/strong><\/a>&nbsp;de Il Sole 24 Ore.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le 12 novembre 2021 dernier, la Cour de cassation, par son arr\u00eat n\u00b0 33809, a de nouveau affront\u00e9 le sujet des contr\u00f4les de la part de l\u2019employeur au moyen de l\u2019utilisation d\u2019instruments informatiques, \u00e0 la lumi\u00e8re des principes et des restrictions applicables en mati\u00e8re de protection des donn\u00e9es personnelles.
