Des d\u00e9cisions r\u00e9centes de la Cour de cassation ont r\u00e9affirm\u00e9 certains principes fondamentaux concernant la l\u00e9gitimit\u00e9 des v\u00e9rifications patronales, que ce soit via des agences d\u2019investigation ou par l\u2019acc\u00e8s aux outils informatiques utilis\u00e9s par les salari\u00e9s. Il est donc essentiel pour les employeurs de savoir comment \u00e9quilibrer la protection des int\u00e9r\u00eats de l\u2019entreprise avec le respect de la vie priv\u00e9e des employ\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le r\u00f4le des agences d\u2019investigation<\/strong><\/h2>\n\n\n\n<p>Une ordonnance r\u00e9cente de la Cour de cassation (Chambre sociale, 12 f\u00e9vrier 2025, n\u00b0 3607) a confirm\u00e9 la l\u00e9gitimit\u00e9 du licenciement pour juste cause d\u2019un salari\u00e9 qui, apr\u00e8s avoir point\u00e9 son badge, s\u2019\u00e9tait \u00e9loign\u00e9 du lieu de travail avec un v\u00e9hicule de l\u2019entreprise pour effectuer des activit\u00e9s personnelles, donc non li\u00e9es \u00e0 l\u2019ex\u00e9cution de ses fonctions. L\u2019\u00e9l\u00e9ment cl\u00e9 de cette affaire r\u00e9side dans le contr\u00f4le effectu\u00e9 par l\u2019entreprise avec l\u2019aide d\u2019un d\u00e9tective priv\u00e9 qui, bien qu\u2019ayant suivi les d\u00e9placements du salari\u00e9 dans des lieux publics, n\u2019a pas viol\u00e9 sa vie priv\u00e9e. En effet, selon la d\u00e9cision, le contr\u00f4le ne portait pas sur un \u00e9ventuel manquement \u00e0 la prestation de travail, mais sur la v\u00e9rification d\u2019une conduite frauduleuse du salari\u00e9.<\/p>\n\n\n\n<p>Les entreprises font souvent appel aux agences d\u2019investigation pour v\u00e9rifier des comportements potentiellement illicites des salari\u00e9s, comme l\u2019absent\u00e9isme injustifi\u00e9 ou l\u2019usage abusif des cong\u00e9s. Cependant, les modalit\u00e9s d\u2019ex\u00e9cution de ces contr\u00f4les sont encadr\u00e9es par des limites pr\u00e9cises, l\u00e9gales et autres. Comme l\u2019a plusieurs fois affirm\u00e9 la jurisprudence, les contr\u00f4les sont l\u00e9gitimes uniquement s\u2019ils visent \u00e0 v\u00e9rifier des comportements du salari\u00e9 qui pourraient constituer des fraudes et donc \u00eatre potentiellement pr\u00e9judiciables \u00e0 l\u2019employeur. Ces contr\u00f4les ne peuvent en aucun cas interf\u00e9rer avec ou concerner directement l\u2019activit\u00e9 de travail elle-m\u00eame.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"20325\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/04\/cyber-sec-1024x679.png\" alt=\"\" class=\"wp-image-20325\"\/><\/figure>\n<\/figure>\n\n\n\n<p>Un exemple typique concerne les contr\u00f4les portant sur l\u2019usage correct des cong\u00e9s pr\u00e9vus par la Loi 104\/1992, \u00e9ventuellement accord\u00e9s aux salari\u00e9s pour l\u2019assistance aux membres de leur famille en situation de handicap. En cas de soup\u00e7ons fond\u00e9s d\u2019abus, l\u2019entreprise peut l\u00e9gitimement mandater une agence d\u2019investigation pour l\u2019aider \u00e0 v\u00e9rifier un \u00e9ventuel comportement illicite, mais les enqu\u00eates doivent \u00eatre cibl\u00e9es, proportionn\u00e9es et limit\u00e9es \u00e0 la v\u00e9rification de l\u2019abus suspect\u00e9. Il est donc essentiel de les utiliser de mani\u00e8re raisonn\u00e9e et justifi\u00e9e, en \u00e9vitant toute forme de surveillance intrusive ou g\u00e9n\u00e9ralis\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contr\u00f4les des dispositifs professionnels<\/strong><\/h2>\n\n\n\n<p>Dans le cadre des contr\u00f4les d\u00e9fensifs, l\u2019employeur pourrait avoir besoin d\u2019acc\u00e9der aux dispositifs professionnels et outils de travail fournis aux salari\u00e9s, tels que, par exemple, ordinateurs portables, t\u00e9l\u00e9phones et bo\u00eetes mail professionnelles. \u00c0 ce sujet, il convient de mentionner la plus r\u00e9cente d\u00e9cision, en date, de la Cour de cassation qui s\u2019est prononc\u00e9e sur la l\u00e9gitimit\u00e9 des contr\u00f4les patronaux effectu\u00e9s notamment par l\u2019acc\u00e8s \u00e0 la bo\u00eete mail professionnelle.<\/p>\n\n\n\n<p>La Cour de cassation, avec l\u2019ordonnance n\u00b0 807 du 13 janvier 2025, a rappel\u00e9 que l\u2019employeur ne peut acc\u00e9der aux mails professionnels d\u2019un salari\u00e9 qu\u2019en cas de soup\u00e7on fond\u00e9 d\u2019infraction. Le contr\u00f4le doit donc \u00eatre justifi\u00e9 par un soup\u00e7on concret d\u2019ill\u00e9galit\u00e9 et ne peut \u00eatre men\u00e9 de mani\u00e8re arbitraire ou r\u00e9troactive.<\/p>\n\n\n\n<p>Cette question appelle une r\u00e9flexion importante sur les contr\u00f4les patronaux dans un contexte o\u00f9 les nouvelles technologies ont largement \u00e9largi les possibilit\u00e9s de surveillance. Il est donc essentiel de d\u00e9finir clairement les limites \u00e0 respecter afin que les actions entreprises et les donn\u00e9es \u00e9ventuellement recueillies soient consid\u00e9r\u00e9es comme l\u00e9gitimes et conformes au cadre juridique actuel.
