Toutefois, cette promesse s\u2019accompagne de risques importants. En raison pr\u00e9cis\u00e9ment de leur incidence potentielle sur les droits fondamentaux, les syst\u00e8mes d\u2019IA utilis\u00e9s dans le contexte du travail sont aujourd\u2019hui consid\u00e9r\u00e9s comme des \u201ctechnologies \u00e0 haut risque\u201d, soumises \u00e0 des obligations strictes de transparence, de supervision humaine et d\u2019\u00e9valuation de l\u2019impact sur les travailleurs.<\/p>\n\n\n\n<p>C\u2019est dans ce contexte que s\u2019ins\u00e8rent les \u201cLignes directrices pour l\u2019utilisation des syst\u00e8mes d\u2019Intelligence Artificielle dans le contexte du travail\u201d publi\u00e9es r\u00e9cemment par le Minist\u00e8re du Travail : il ne s\u2019agit pas d\u2019une norme contraignante, mais d\u2019un document strat\u00e9gique qui repr\u00e9sente une orientation politique et culturelle claire pour le tissu productif italien, avec une attention particuli\u00e8re port\u00e9e aux PME. L\u2019objectif est double : promouvoir une adoption consciente de l\u2019IA et assurer la pleine protection des droits des travailleurs.<\/p>\n\n\n\n<p>Le document repose sur un message sans \u00e9quivoque : l\u2019IA ne peut pas \u00eatre une \u201cbo\u00eete noire\u201d qui d\u00e9cide de mani\u00e8re opaque et incontestable. M\u00eame lorsque la technologie est d\u00e9velopp\u00e9e par des tiers, la responsabilit\u00e9 finale incombe toujours \u00e0 l\u2019employeur. Pour les entreprises, il s\u2019agit de passer d\u2019une phase exp\u00e9rimentale \u00e0 une gestion structur\u00e9e, conforme aux principes de conformit\u00e9 et de durabilit\u00e9.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/AI-1024x576.png\" alt=\"\" class=\"wp-image-19726\"\/><\/figure>\n\n\n\n<p><strong>Les quatre piliers des lignes directrices relatives \u00e0 l\u2019utilisation de l\u2019IA<\/strong><\/p>\n\n\n\n<p>Le document minist\u00e9riel s\u2019articule autour de quatre axes fondamentaux, qui formalisent des obligations d\u00e9j\u00e0 pr\u00e9sentes dans le cadre normatif et jurisprudentiel actuel, tout en en renfor\u00e7ant l\u2019application dans une perspective pr\u00e9ventive.<\/p>\n\n\n\n<p><strong>1. Supervision humaine obligatoire<\/strong><\/p>\n\n\n\n<p>Les d\u00e9cisions qui influencent la position juridique du travailleur \u2013 embauches, promotions, \u00e9valuations, mesures disciplinaires ou licenciements \u2013 ne peuvent pas \u00eatre laiss\u00e9es \u00e0 la seule appr\u00e9ciation algorithmique. Un contr\u00f4le humain effectif, conscient et tra\u00e7able est n\u00e9cessaire, exerc\u00e9 par une personne comp\u00e9tente et habilit\u00e9e. Cette personne doit \u00eatre en mesure de comprendre, valider ou m\u00eame contester les indications de la machine, en assumant l\u2019enti\u00e8re responsabilit\u00e9 de la d\u00e9cision finale.<\/p>\n\n\n\n<p><strong>2. Obligation de transparence algorithmique<\/strong><\/p>\n\n\n\n<p>Les entreprises doivent informer de mani\u00e8re claire et accessible les travailleurs de l\u2019utilisation de l\u2019IA dans les processus qui les concernent. Une communication g\u00e9n\u00e9rique ne suffit pas : il faut expliquer quelles donn\u00e9es sont trait\u00e9es (CV, performances, tests d\u2019aptitude), quelles logiques et quels crit\u00e8res l\u2019algorithme utilise et quel impact cela a sur la d\u00e9cision finale. Le principe directeur est \u00ab l\u2019intelligibilit\u00e9 \u00bb : le syst\u00e8me doit \u00eatre explicable, compr\u00e9hensible et contestable.<\/p>\n\n\n\n<p><strong>3. \u00c9valuation d\u2019impact et att\u00e9nuation du risque<\/strong><\/p>\n\n\n\n<p>Conform\u00e9ment \u00e0 l\u2019AI Act europ\u00e9en, l\u2019utilisation de l\u2019IA dans le domaine des ressources humaines est qualifi\u00e9e d\u2019activit\u00e9 \u00e0 haut risque. Il en d\u00e9coule une obligation pour l\u2019employeur d\u2019effectuer, avant la mise en service, une \u00e9valuation d\u2019impact tenant compte des effets discriminatoires potentiels, de la protection de la vie priv\u00e9e et de la qualit\u00e9 des donn\u00e9es utilis\u00e9es. Les Lignes directrices encouragent \u00e9galement l\u2019introduction d\u2019audits p\u00e9riodiques et de contr\u00f4les syst\u00e9matiques sur le fonctionnement des algorithmes.<\/p>\n\n\n\n<p><strong>4. Cartographie et accountability<\/strong><\/p>\n\n\n\n<p>L\u2019entreprise doit savoir quels syst\u00e8mes d\u2019IA elle utilise, o\u00f9, \u00e0 quelles fins et qui en est responsable. La responsabilit\u00e9 ne peut pas \u00eatre d\u00e9l\u00e9gu\u00e9e au fournisseur de la technologie : c\u2019est \u00e0 l\u2019organisation de garantir une utilisation correcte et \u00e9thique des syst\u00e8mes, \u00e0 travers une gouvernance interne appropri\u00e9e.
