Consid\u00e9rant la d\u00e9cision des juges du fond correcte, la Cassation a exclu la violation pr\u00e9tendue de l&rsquo;article 4 du Statut des travailleurs plaid\u00e9e par l&#8217;employ\u00e9 au motif que l&#8217;employeur, pour v\u00e9rifier son comportement illicite, n&rsquo;a pas utilis\u00e9 de mat\u00e9riel audiovisuel ou autre \u00e9quipement pr\u00e9dispos\u00e9 \u00e0 la surveillance \u00e0 distance de l&rsquo;activit\u00e9 professionnelle, mais les r\u00e9sultats issus des relev\u00e9s t\u00e9l\u00e9phoniques. En effet, selon la Cour, \u00ab il est tout \u00e0 fait l\u00e9gitime que l&#8217;employeur, dans le contr\u00f4le de la gestion de son activit\u00e9, puisse d\u00e9tecter des anomalies dans l&rsquo;utilisation des biens fournis \u00e0 ses employ\u00e9s, tels que les t\u00e9l\u00e9phones portables, dont les relev\u00e9s t\u00e9l\u00e9phoniques, relatifs au trafic voix ou de donn\u00e9es (transmis avec les factures, par ailleurs avec les omissions dues et les masquages appropri\u00e9s), laissent appara\u00eetre des \u00e9tranget\u00e9s pouvant \u00eatre consid\u00e9r\u00e9es comme des abus de la part des attributaires \u00bb.
