Ce pouvoir appartient uniquement aux parties qui ont sign\u00e9 la CCNT, soit aux organisations syndicales et patronales. Selon la Cour de cassation, l&#8217;employeur pris individuellement n&rsquo;est pas autoris\u00e9 \u00e0 r\u00e9silier unilat\u00e9ralement la convention collective, m\u00eame pas au motif que celle-ci est excessivement on\u00e9reuse, au regard de ses difficult\u00e9s \u00e9conomiques. Par cons\u00e9quent, l&#8217;employeur est li\u00e9 par la CCNT, m\u00eame s&rsquo;il d\u00e9missionne de l&rsquo;organisation syndicale \u00e0 laquelle il appartient. Toutefois, il a le droit de r\u00e9silier la CCNT conclue pour une dur\u00e9e ind\u00e9termin\u00e9e ne pr\u00e9voyant pas de date d&rsquo;expiration. En effet, le contrat ne peut pas lier toutes les parties contractantes pour toujours, sinon le d\u00e9veloppement des relations industrielles ne serait pas possible, ce qui contrecarrerait la cause et la fonction sociale de la n\u00e9gociation collective. Il est entendu que la r\u00e9siliation doit \u00eatre exerc\u00e9e dans le respect des principes de loyaut\u00e9 et de bonne foi et sans porter atteinte aux droits intangibles des travailleurs. En l&rsquo;esp\u00e8ce, selon la Cour de cassation, il n&rsquo;y a aucune obligation pour l&#8217;employeur de n\u00e9gocier et de conclure la CCNT avec tous les syndicats.
