La Cour pr\u00e9cise, en outre, que les cons\u00e9quences dudit caract\u00e8re\nannulable du licenciement doivent \u00eatre assimil\u00e9es \u00e0 celles applicables en cas\nde licenciement ill\u00e9gitime pour violation av\u00e9r\u00e9e des crit\u00e8res de s\u00e9lection.\nL\u2019affaire sur laquelle la Haute Cour a \u00e9t\u00e9 amen\u00e9e \u00e0 se prononcer concerne un\nsalari\u00e9 embauch\u00e9 dans le cadre de la r\u00e9glementation relative au placement\nobligatoire et qui avait \u00e9t\u00e9 licenci\u00e9 \u00e0 l\u2019occasion d&rsquo;une proc\u00e9dure de\nlicenciement collectif. Les juridictions territorialement comp\u00e9tentes de\npremier et second degr\u00e9 appel\u00e9es \u00e0 trancher sur la demande du salari\u00e9 visant \u00e0 obtenir\nla d\u00e9claration du caract\u00e8re ill\u00e9gitime du licenciement avec les cons\u00e9quences\nqui s\u2019en suivent en droit, y avaient fait droit, condamnant l\u2019employeur \u00e0\nr\u00e9int\u00e9grer le salari\u00e9 dans son poste de travail et \u00e0 lui r\u00e9gler une indemnit\u00e9\nen dommages et int\u00e9r\u00eats \u00e9gale \u00e0 12 mois de la derni\u00e8re r\u00e9tribution globale de\nfait. En particulier, la Cour d\u2019appel de Rome avait confirm\u00e9 la d\u00e9cision de\npremi\u00e8re instance partant du principe qu&rsquo;il n\u2019avait pas \u00e9t\u00e9 contest\u00e9 qu\u2019il\ns\u2019agissait d&rsquo;un salari\u00e9 embauch\u00e9 \u00e0 titre obligatoire, ainsi que du fait, non\ncontrovers\u00e9e d\u00e9sormais et rev\u00eatant la force de la chose jug\u00e9e interne, dans la\nmesure o\u00f9 l\u2019employeur n\u2019avait pas rapport\u00e9 de preuve contraire \u00e0 ce propos,\nqu\u2019au moment de la cessation du rapport le nombre restant de salari\u00e9s prot\u00e9g\u00e9s\ns\u2019av\u00e9rait inf\u00e9rieur au quota de r\u00e9serve. La soci\u00e9t\u00e9 employeur s\u2019est pourvue en\ncassation \u00e0 l\u2019encontre de l\u2019arr\u00eat rendu par la Cour d\u2019appel de Rome, invoquant\nun moyen unique. L\u2019employeur a soutenu ne pas avoir choisi le salari\u00e9 handicap\u00e9\npour le licencier de mani\u00e8re anticip\u00e9e, mais qu&rsquo;il avait appliqu\u00e9 une clause de\nla convention syndicale qui pr\u00e9voyait la sous-traitance du service dont il\nrelevait, et qu&rsquo;il avait, de toute fa\u00e7on, propos\u00e9 au salari\u00e9 de le relocaliser\ndans le m\u00eame site de production avec les m\u00eames t\u00e2ches que celles qu\u2019il\nr\u00e9alisait auparavant, dans les locaux de la soci\u00e9t\u00e9 \u00e0 laquelle le service avait\n\u00e9t\u00e9 sous-trait\u00e9, offre laquelle le salari\u00e9 a refus\u00e9e.
