Le salari\u00e9 disposait d&rsquo;un\nbureau avec une entr\u00e9e ind\u00e9pendante sis \u00e0 Bologne, adjacent \u00e0 l\u2019un des points\nde vente de la soci\u00e9t\u00e9 mais totalement ind\u00e9pendant de ce dernier car s\u00e9par\u00e9 par\nun mur. Le salari\u00e9 \u00e9tait tenu d\u2019enregistrer ses heures d\u2019arriv\u00e9e et de d\u00e9part\npar le biais du syst\u00e8me de pointage, ou en cas d&rsquo;oubli, au moyen de l\u2019insertion\nmanuelle des horaires dans un tableur <em>ad hoc<\/em> fourni par la soci\u00e9t\u00e9\n(m\u00e9thode consid\u00e9r\u00e9e suppl\u00e9tive et non pas alternative par rapport \u00e0 la\npremi\u00e8re). Ceci \u00e9tant dit, un pr\u00e9pos\u00e9 du Bureau charg\u00e9 de la s\u00e9curit\u00e9 de la\nsoci\u00e9t\u00e9 s\u2019\u00e9tait rendu, afin d\u2019effectuer des v\u00e9rifications dans les\ninstallations des alarmes, dans le point de vente de Bologne, et \u00e0 cette\noccasion, il avait visit\u00e9 le bureau adjacent du salari\u00e9 qui, pendant la\njourn\u00e9e, n\u2019y \u00e9tait pas pr\u00e9sent. Le pr\u00e9pos\u00e9 du Bureau charg\u00e9 de la s\u00e9curit\u00e9 en\navait averti la soci\u00e9t\u00e9, laquelle a organis\u00e9 toute une s\u00e9rie de contr\u00f4les des\nenregistrements des pr\u00e9sences du salari\u00e9 pour d\u00e9couvrir que ce dernier\nenregistrait souvent ses pr\u00e9sences par le biais de saisies manuelles dans le\ntableur. C\u2019est dans ces conditions que la soci\u00e9t\u00e9 a consid\u00e9r\u00e9 opportun de\nlancer diff\u00e9rents contr\u00f4les faisant appel \u00e0 un cabinet de d\u00e9tectives,\nconcernant les activit\u00e9s du requ\u00e9rant. L\u2019enqu\u00eate a d\u00e9montr\u00e9 que pendant les horaires\nde travail, bien que le contraire ait \u00e9t\u00e9 attest\u00e9 sur les tableurs indiquant\nles pr\u00e9sences, le salari\u00e9 effectuait souvent des d\u00e9marches personnelles au lieu\nde s\u2019acquitter de ses t\u00e2ches au profit de la soci\u00e9t\u00e9, et cela pendant des\nlongues heures lesquelles, bien \u00e9videmment, \u00e9taient d\u00fbment r\u00e9mun\u00e9r\u00e9es. Un tel\ncomportement avait fait l\u2019objet d&rsquo;une proc\u00e9dure disciplinaire qui avait\nd\u00e9bouch\u00e9 sur un licenciement pour juste cause du salari\u00e9. C\u2019est dans ces\nconditions que ce dernier, apr\u00e8s avoir conteste le licenciement, avait\nintroduit une action devant le Tribunal de Padoue, demandant la constatation et\nla d\u00e9claration de la nullit\u00e9 et\/ou du caract\u00e8re annulable et\/ou l\u2019absence\nd\u2019effet et\/ou l&rsquo;ill\u00e9gitimit\u00e9 du licenciement prononc\u00e9 par la soci\u00e9t\u00e9 car d\u00e9pourvu\nde juste cause et en tout \u00e9tat de cause inh\u00e9rent \u00e0 une conduite punissable avec\nune sanction conservatoire.
