En l\u2019esp\u00e8ce, l\u2019INPS avait m\u00e9connu le d\u00e9gr\u00e8vement de cotisations sur les primes de r\u00e9sultat vers\u00e9es sur la base d\u2019un accord sign\u00e9 chaque ann\u00e9e par l\u2019employeur et un repr\u00e9sentant des travailleurs. La Cour lui a donn\u00e9 raison car ces accords ont un caract\u00e8re obligatoire comparable aux conventions collectives nationales, m\u00eame s\u2019ils s\u2019appliquent \u00e0 une entreprise ou partie d\u2019entreprise, et ne sont pas la somme de contrats individuels, mais des actes ayant une autonomie syndicale et d\u00e9fendant les int\u00e9r\u00eats collectifs de la communaut\u00e9 des travailleurs. L\u2019\u00e9ventuelle indivisibilit\u00e9 de la r\u00e9glementation qui en r\u00e9sulte justifie son efficacit\u00e9 erga omnes. Les accords d\u2019entreprise sign\u00e9s par l\u2019employeur et par un repr\u00e9sentant des travailleurs non syndicaliste ne justifient donc pas les d\u00e9gr\u00e8vements, du fait de leur absence repr\u00e9sentativit\u00e9.
