L&rsquo;utilisation de ces heures \u00e0 d\u2019autres fins constitue une absence susceptible de justifier un licenciement. N\u00e9anmoins, selon la Cour de Cassation, une faute relev\u00e9e in abstracto ne dispense pas l\u2019employeur de v\u00e9rifier sa gravit\u00e9, in concreto, pour d\u00e9terminer si le salari\u00e9 prot\u00e9g\u00e9 est passible de licenciement pour faute. Cette \u00e9valuation est confi\u00e9e au juge. En l\u2019esp\u00e8ce, apr\u00e8s instruction, le licenciement a \u00e9t\u00e9 jug\u00e9 disproportionn\u00e9 sous l\u2019angle du comportement du salari\u00e9. Il avait en effet \u00e9t\u00e9 reproch\u00e9 au repr\u00e9sentant syndical de s\u2019\u00eatre absent\u00e9 de son poste de fa\u00e7on arbitraire, en ayant men\u00e9, sur ses heures de d\u00e9l\u00e9gation, des activit\u00e9s qui n\u2019\u00e9taient pas celles pour lesquelles l\u2019absence avait \u00e9t\u00e9 autoris\u00e9e. Il s\u2019\u00e9tait cependant av\u00e9r\u00e9 que le salari\u00e9, m\u00eame s\u2019il n\u2019avait pas particip\u00e9 \u00e0 une r\u00e9union syndicale avait en tout \u00e9tat de cause exerc\u00e9 des activit\u00e9s li\u00e9es \u00e0 son mandat.
