obligations du travailleur &#8211; refus de porter un masque &#8211; pertinence disciplinaire &#8211; l\u00e9gitimit\u00e9 de la suspension du travail et de la r\u00e9mun\u00e9ration<\/strong><\/h2>\n\n\n\n<p><em>&nbsp;\u00ab&nbsp;Compte tenu de la situation tragique \u00e0 laquelle le pays et le monde entier ont d\u00fb faire face \u00e0 cause de l&rsquo;\u00e9pid\u00e9mie de Covid-19, le fait d\u2019imposer aux travailleurs l&rsquo;utilisation du masque par [l&#8217;employeur], \u00e9nonc\u00e9 dans le protocole commun avec les syndicats, n&rsquo;est certainement pas une mesure irrationnelle ni excessivement contraignante, mais r\u00e9pond pleinement au devoir de l&#8217;employeur de prot\u00e9ger au mieux ses employ\u00e9s&nbsp;\u00bb.<\/em> Le comportement d&rsquo;un salari\u00e9 qui refuse de porter un masque lors d&rsquo;une r\u00e9union d&rsquo;entreprise semble donc tout \u00e0 fait inappropri\u00e9&nbsp;; ainsi la sanction disciplinaire de suspension de travail et de r\u00e9mun\u00e9ration, impos\u00e9e par l&#8217;employeur, est l\u00e9gitime.<\/p>\n\n\n\n<p><strong>Pr\u00e9ambule<\/strong><\/p>\n\n\n\n<p>Comme chacun le sait, l&rsquo;article 2087 du Code civil italien impose \u00e0 l&#8217;employeur l&rsquo;obligation d&rsquo; \u00ab&nbsp;<em>adopter dans l&rsquo;exercice de l\u2019activit\u00e9 de l&rsquo;entreprise les mesures qui, en fonction de la nature particuli\u00e8re du travail, de l&rsquo;exp\u00e9rience et de la technique, sont n\u00e9cessaires pour prot\u00e9ger l&rsquo;int\u00e9grit\u00e9 physique et la personnalit\u00e9 morale des salari\u00e9s&nbsp;\u00bb.<\/em><\/p>\n\n\n\n<p>Dans le contexte d&rsquo;urgence impos\u00e9 par la propagation du virus Covid-19, le d\u00e9cret-loi <em>Cura Italia<\/em> a assimil\u00e9 l&rsquo;infection par la Covid-19 contract\u00e9e sur le lieu de travail \u00e0 un accident, rendant encore plus lourde la charge de l&#8217;employeur de faire respecter par les travailleurs les mesures introduites dans l&rsquo;entreprise pour prot\u00e9ger leur sant\u00e9 et leur s\u00e9curit\u00e9.<\/p>\n\n\n\n<p>Comme chacun le sait, dans le contexte d&rsquo;urgence, le gouvernement et les partenaires sociaux ont sign\u00e9, tout d&rsquo;abord le 14 mars 2020, le <em>\u00ab&nbsp;Protocole commun pour la r\u00e9glementation des mesures visant \u00e0 combattre et \u00e0 limiter la propagation du virus Covid-19 sur le lieu de travail&nbsp;\u00bb, <\/em>actualis\u00e9 par le Protocole du 24 avril 2020 et, enfin, le 6 avril 2021, par le <em>\u00ab&nbsp;Protocole commun pour la mise \u00e0 jour des mesures visant \u00e0 limiter la propagation du virus SARS-Co V-2\/COVID-19 sur le lieu de travail&nbsp;\u00bb.<\/em><\/p>\n\n\n\n<p>L&rsquo;obligation pour l&#8217;employeur de fournir aux travailleurs des masques chirurgicaux &#8211; dont l&rsquo;utilisation est obligatoire dans tous les espaces de travail communs, int\u00e9rieurs ou ext\u00e9rieurs &#8211; est l&rsquo;une des mesures de s\u00e9curit\u00e9 pr\u00e9vues par le r\u00e8glement d&rsquo;urgence.<\/p>\n\n\n\n<p>Outre les obligations de l&#8217;employeur impos\u00e9es par la l\u00e9gislation en vigueur en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9, il existe \u00e9galement une v\u00e9ritable obligation pour le travailleur de coop\u00e9rer \u00e0 la mise en \u0153uvre des mesures prises par l&#8217;employeur pour prot\u00e9ger la sant\u00e9 et la s\u00e9curit\u00e9 sur le lieu de travail, comme le pr\u00e9voit l&rsquo;article 20 du Texte Unique sur la sant\u00e9 et la s\u00e9curit\u00e9.<\/p>\n\n\n\n<p>Lire la suite dans la version compl\u00e8te publi\u00e9e par <a href=\"http:\/\/www.guidaallavorodigital.ilsole24ore.com\/art\/primo-piano\/2021-07-09\/rifiuto-indossare-mascherina-legittima-sospensione-lavoro-e-retribuzione-093308.php?uuid=AEHfj8T\">Guida al Lavoro <\/a>de Il Sole 24 Ore.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le principe Sant\u00e9 et s\u00e9curit\u00e9 au travail &#8211;
