Selon la Cour, l\u2019interdiction de porter sur le lieu de travail toute forme visible d\u2019expression des convictions politiques, philosophiques ou religieuses peut \u00eatre justifi\u00e9e par la n\u00e9cessit\u00e9 pour l\u2019employeur \u00ab<em>de se pr\u00e9senter de fa\u00e7on neutre face aux clients ou de pr\u00e9venir des conflits sociaux \u00bb.<\/em><\/p>\n\n\n\n<p>La d\u00e9cision des juges europ\u00e9ens tire son origine d\u2019une requ\u00eate pr\u00e9sent\u00e9e par-devant le Tribunal du travail de Hambourg par deux employ\u00e9es d\u2019une soci\u00e9t\u00e9 de droit allemand, invit\u00e9es \u00e0 ne pas porter de signes attestant leur appartenance religieuse.<\/p>\n\n\n\n<p>Les juges de renvoi ont d\u00e9cid\u00e9 d\u2019interroger la Cour sur l\u2019interpr\u00e9tation de la Directive 2000\/78. Notamment, ils ont demand\u00e9 si la r\u00e8gle interne d\u2019une entreprise, interdisant aux travailleurs de porter sur le lieu de travail des signes visibles de convictions politiques, philosophiques ou religieuses constitue une discrimination directe ou indirecte fond\u00e9e sur les convictions personnelles ; \u00e0 quelles conditions l\u2019\u00e9ventuelle diff\u00e9rence de traitement fond\u00e9e sur les convictions personnelles d\u00e9coulant de cette r\u00e8gle peut \u00eatre justifi\u00e9e et quels sont les \u00e9l\u00e9ments \u00e0 prendre en compte dans le cadre de l\u2019examen du caract\u00e8re appropri\u00e9 de cette diff\u00e9rence de traitement.<\/p>\n\n\n\n<p>Les juges communautaires ont affirm\u00e9 que le r\u00e8glement d\u2019une entreprise ayant les caract\u00e9ristiques susmentionn\u00e9es ne constitue pas une discrimination directe fond\u00e9e sur les convictions personnelles envers les travailleurs, \u00e0 la condition que \u00ab<em>cette r\u00e8gle soit appliqu\u00e9e de fa\u00e7on g\u00e9n\u00e9rale et indiff\u00e9renci\u00e9e<\/em> \u00bb.
