La Cour de cassation a d\u00e9clar\u00e9 ce pourvoi inadmissible et a pr\u00e9cis\u00e9 que, pour \u00e9valuer une disparit\u00e9 d\u00e9raisonnable, l\u2019\u00e9ventuelle prise en compte de situations analogues doit se fonder sur des all\u00e9gations effectu\u00e9es au cours de la proc\u00e9dure et permettant d\u2019effectuer une comparaison.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits et l\u2019issue de la proc\u00e9dure au fond<\/strong><\/h2>\n\n\n\n<p>Le cas d\u2019esp\u00e8ce soumis \u00e0 la Cour de cassation concerne le cas d\u2019un travailleur ayant contest\u00e9 en justice son licenciement disciplinaire pour avoir provoqu\u00e9, alors qu\u2019il conduisait le v\u00e9hicule de l\u2019entreprise, un accident de la route, endommageant un pont situ\u00e9 sur la route d\u00e9partementale qu\u2019il parcourait.<\/p>\n\n\n\n<p>Plus pr\u00e9cis\u00e9ment, en cette occasion le v\u00e9hicule de service conduit par le salari\u00e9, \u00e0 l\u2019arri\u00e8re duquel se trouvait une grue, avait heurt\u00e9, \u00e0 cause du mauvais positionnement de cette derni\u00e8re, la poutre d\u2019un pont situ\u00e9 sur la route d\u00e9partementale parcourue.<\/p>\n\n\n\n<p>La soci\u00e9t\u00e9 employeur avait rompu le contrat de travail sans pr\u00e9avis, sur la base de la grave inex\u00e9cution du salari\u00e9, \u00e0 l\u2019origine de l\u2019accident, et car ce dernier n\u2019avait pas rempli le disque horaire et le chronotachygraphe attestant la vitesse du v\u00e9hicule.<\/p>\n\n\n\n<p>La&nbsp;Cour d\u2019Appel de Bologne, par son arr\u00eat n\u00b0 469\/2019, a rejet\u00e9 l\u2019appel interjet\u00e9 par le travailleur contre la d\u00e9cision par laquelle le Tribunal de Ferrara avait d\u00e9clar\u00e9 l\u00e9gitime le licenciement qui lui avait \u00e9t\u00e9 inflig\u00e9 par la soci\u00e9t\u00e9 employeur, \u00e0 cause de l\u2019accident survenu.<\/p>\n\n\n\n<p>Plus pr\u00e9cis\u00e9ment, pour ce qui nous int\u00e9resse ici, la Cour d\u2019appel avait consid\u00e9r\u00e9 ce licenciement comme l\u00e9gitime, en raison de la gravit\u00e9 du comportement qui avait fortement port\u00e9 atteinte au lien de confiance. Elle avait m\u00eame consid\u00e9r\u00e9 la sanction du licenciement comme proportionn\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le pourvoi en cassation<\/strong><\/h2>\n\n\n\n<p>Le travailleur s\u2019est pourvu en cassation contre la d\u00e9cision, avec un seul motif de pourvoi, invoquant une disparit\u00e9 de traitement avec certains de ses coll\u00e8gues, qui par le pass\u00e9 avaient tenu des comportements similaires sans avoir \u00e9t\u00e9 licenci\u00e9s.<\/p>\n\n\n\n<p>\u00c0 ce sujet, le requ\u00e9rant soulignait que la Cour d\u2019Appel n\u2019avait pas tenu compte de l\u2019exception soulev\u00e9e sur le fait que d\u2019autres travailleurs ayant commis des inex\u00e9cutions similaires avaient \u00e9t\u00e9 trait\u00e9s de fa\u00e7on diff\u00e9rente.<\/p>\n\n\n\n<p>Notamment, le travailleur rappelait les principes exprim\u00e9s par la Cour de cassation selon lesquels \u00ab<em> bien que, pour d\u00e9terminer l\u2019existence d\u2019une juste cause ou d\u2019un juste motif de licenciement, il importe peu qu\u2019une inex\u00e9cution analogue commise par un autre salari\u00e9 ait \u00e9t\u00e9 trait\u00e9e diff\u00e9remment par l\u2019employeur, au cas o\u00f9 il serait \u00e9tabli que l\u2019inex\u00e9cution du travailleur serait de nature \u00e0 compromettre de fa\u00e7on irr\u00e9m\u00e9diable le lien de confiance, l\u2019identit\u00e9 des situations peut priver la d\u00e9cision de licenciement de sa justification<\/em> \u00bb (parmi les arr\u00eats nous rappelons Cass. n\u00b0 14251\/2015 ;&nbsp;Cass. n\u00b0 5546\/2010 ;&nbsp;Cass. n\u00b0 10550\/2013).<\/p>\n\n\n\n<p>Toutefois, afin de mieux comprendre le raisonnement et les arguments \u00e0 la base de la d\u00e9cision de la Cour de cassation que nous examinerons plus bas, il faut rappeler, de fa\u00e7on enti\u00e8re et compl\u00e8te, le principe de droit invoqu\u00e9 par le travailleur demandeur au pourvoi.<\/p>\n\n\n\n<p>En effet, selon l\u2019arr\u00eat de la Cour de cassation n\u00b0 14251\/2015, il convient de suivre son orientation consolid\u00e9e selon laquelle, pour d\u00e9terminer l\u2019existence d\u2019une juste cause ou d\u2019un juste motif de licenciement, au cas o\u00f9 il serait \u00e9tabli que l\u2019inex\u00e9cution du travailleur serait de nature \u00e0 compromettre de fa\u00e7on irr\u00e9m\u00e9diable le lien de confiance, il importe peu qu\u2019une inex\u00e9cution analogue commise par un autre salari\u00e9 ait \u00e9t\u00e9 trait\u00e9e diff\u00e9remment par l\u2019employeur.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale sur&nbsp;<a href=\"https:\/\/modulo24contenziosolavoro.ilsole24ore.com\/private\/default.aspx#\/showdoc\/39054459\">Modulo24 Contentieux du travail<\/a>&nbsp;de Il Sole 24 ore.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation s\u2019est prononc\u00e9e sur le pourvoi d\u2019un salari\u00e9 ayant contest\u00e9 le licenciement disciplinaire qui lui avait \u00e9t\u00e9 inflig\u00e9 pour avoir provoqu\u00e9 un accident de la route au volant du v\u00e9hicule de service, en invoquant une disparit\u00e9 de traitement avec des coll\u00e8gues qui, dans des situations similaires, n\u2019avaient pas subi une telle sanction.
