La jurisprudence a fourni au fil des ans des indications importantes. Quelles v\u00e9rifications doit effectuer l\u2019employeur et quels sont les devoirs du salari\u00e9 ?<\/p>\n\n\n\n<p>Le th\u00e8me du d\u00e9passement de la p\u00e9riode de maintien en cas de maladie constitue un aspect de grande importance dans la gestion des ressources humaines. D\u2019un c\u00f4t\u00e9, il y a la protection du salari\u00e9 qui, en cas de pathologies graves ou prolong\u00e9es, a besoin d\u2019une p\u00e9riode d\u2019absence ad\u00e9quate pour se soigner sans perdre son emploi. De l\u2019autre, les entreprises doivent garantir la continuit\u00e9 op\u00e9rationnelle et peuvent rencontrer des difficult\u00e9s \u00e0 g\u00e9rer des absences prolong\u00e9es.<\/p>\n\n\n\n<p>La gestion du d\u00e9passement de la p\u00e9riode de maintien en cas de maladie n\u00e9cessite donc une approche \u00e9quilibr\u00e9e et attentive : l\u2019employeur doit v\u00e9rifier le respect des normes contractuelles et agir dans le respect du principe de bonne foi, en \u00e9vitant des mesures pr\u00e9cipit\u00e9es ou discriminatoires.<\/p>\n\n\n\n<p>Le salari\u00e9, quant \u00e0 lui, a le devoir de communiquer correctement sa situation et de respecter les r\u00e8gles pr\u00e9vues par le contrat et la loi. La jurisprudence a fourni au fil du temps des indications fondamentales pour concilier ces int\u00e9r\u00eats, mais seule une \u00e9valuation attentive de chaque cas peut garantir le juste \u00e9quilibre entre la protection du salari\u00e9 et les besoins de l\u2019entreprise.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"20183\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/03\/shutterstock_1726274593-1024x683.jpg\" alt=\"\" class=\"wp-image-20183\"\/><\/figure>\n<\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Que dit la loi sur le d\u00e9passement de la p\u00e9riode de maintien du poste ?<\/h3>\n\n\n\n<p>La p\u00e9riode de maintien du poste est principalement r\u00e9gie par l\u2019article 2110 du Code civil, qui \u00e9tablit qu\u2019en cas de maladie, le salari\u00e9 a droit \u00e0 la <strong>conservation de son emploi pour une dur\u00e9e d\u00e9termin\u00e9e par les conventions collectives<\/strong>. Au-del\u00e0 de cette limite, l\u2019employeur peut rompre le contrat de travail, sous r\u00e9serve du droit \u00e0 l\u2019indemnit\u00e9 de pr\u00e9avis.<\/p>\n\n\n\n<p>En outre, la <strong>Loi 300\/1970<\/strong> (Statut des travailleurs), \u00e0 son article 18, traite de la cessation du contrat de travail : cette disposition prot\u00e8ge le salari\u00e9 contre les licenciements prononc\u00e9s en violation de l\u2019article 2110, deuxi\u00e8me alin\u00e9a, du Code civil, en pr\u00e9voyant le droit \u00e0 la r\u00e9int\u00e9gration dans l\u2019emploi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jurisprudence exemplaire<\/h3>\n\n\n\n<p>Au fil des ann\u00e9es, plusieurs d\u00e9cisions de la Cour de cassation ont attir\u00e9 l\u2019attention concernant le d\u00e9passement de la p\u00e9riode de maintien du poste et ont pr\u00e9cis\u00e9 que l\u2019employeur doit consid\u00e9rer la situation sp\u00e9cifique du salari\u00e9 et \u00e9valuer d\u2019\u00e9ventuelles alternatives avant de proc\u00e9der au licenciement.<\/p>\n\n\n\n<p>En plus du cas tr\u00e8s m\u00e9diatis\u00e9 d\u2019un salari\u00e9 licenci\u00e9 alors qu\u2019il restait encore quelques jours avant la fin de la p\u00e9riode de maintien du poste (Cassation n\u00b0 24766\/2017), voici quelques arr\u00eats marquants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Cassation n\u00b0 11815\/2016<\/strong> : la Cour a r\u00e9affirm\u00e9 que le licenciement pour d\u00e9passement de la p\u00e9riode de maintien est l\u00e9gitime seulement si l\u2019employeur d\u00e9montre avoir correctement calcul\u00e9 les jours d\u2019absence et pris en compte d\u2019\u00e9ventuelles suspensions du calcul (par exemple, cong\u00e9s ou accidents du travail).<\/li>\n\n\n\n<li><strong>Cassation n\u00b0 6464\/2020<\/strong> : il a \u00e9t\u00e9 soulign\u00e9 que le licenciement d\u2019un salari\u00e9 pour d\u00e9passement de la p\u00e9riode de maintien est ill\u00e9gitime si l\u2019employeur n\u2019a pas envisag\u00e9 la possibilit\u00e9 de le r\u00e9affecter \u00e0 des fonctions compatibles avec son \u00e9tat de sant\u00e9 r\u00e9siduel.<\/li>\n\n\n\n<li><strong>Cassation n\u00b0 26675\/2018<\/strong> : la Cour a confirm\u00e9 que l\u2019employeur doit envisager des solutions alternatives, comme le reclassement du salari\u00e9 dans un poste moins contraignant, avant de proc\u00e9der au licenciement.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">V\u00e9rifications \u00e0 effectuer par l\u2019employeur<\/h3>\n\n\n\n<p>Pour \u00e9viter les litiges, l\u2019employeur doit proc\u00e9der \u00e0 des v\u00e9rifications rigoureuses avant de prendre des mesures disciplinaires.
