La r\u00e9f\u00e9rence faite aux conventions collectives ne suffit pas<\/strong><\/p>\n\n\n\n<p>Le d\u00e9cret l\u00e9gislatif d\u2019application de la directive europ\u00e9enne sur la transparence (directive n\u00b0 2019\/1152), qui devra \u00eatre re\u00e7ue avant le 1<sup>er<\/sup> ao\u00fbt, a pour objectif de garantir aux travailleurs une connaissance d\u00e9taill\u00e9e des conditions du contrat de travail et des garanties minimum de pr\u00e9visibilit\u00e9 du d\u00e9roulement de ce contrat. Un simple renvoi \u00e0 la n\u00e9gociation collective du secteur, comme il est actuellement pr\u00e9vu par la presque totalit\u00e9 des contrats de travail en vigueur, ne sera donc plus suffisant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les modalit\u00e9s de communication<\/strong><\/h2>\n\n\n\n<p>Ces obligations d\u2019information devront \u00eatre ex\u00e9cut\u00e9es par \u00e9crit par l\u2019employeur, avant le commencement de la prestation de travail, directement dans le contrat de travail ou bien au moyen de la remise d\u2019une copie de la communication d\u2019instauration du contrat. Certaines informations pourront de plus \u00eatre fournies dans les sept jours ou bien dans le mois suivant le d\u00e9but de la prestation de travail.<\/p>\n\n\n\n<p>Toute variation au contrat de travail qui surviendrait apr\u00e8s l\u2019embauche devra \u00eatre communiqu\u00e9e par \u00e9crit au travailleur au plus tard le premier jour d\u2019application des effets de cette modification.<\/p>\n\n\n\n<p>Les nouvelles obligations d\u2019information, de plus, s\u2019appliqueront non seulement envers les salari\u00e9s et les collaborateurs nouvellement embauch\u00e9s mais aussi, sur demande du travailleur, aux contrats d\u00e9j\u00e0 en vigueur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La protection du salari\u00e9<\/strong><\/h2>\n\n\n\n<p>Les travailleurs qui invoqueraient la violation des droits pr\u00e9vus par le d\u00e9cret d\u2019application et, donc, par le d\u00e9cret l\u00e9gislatif n\u00b0 152\/1997, auront non seulement la facult\u00e9 de saisir l\u2019autorit\u00e9 judiciaire, mais ils pourront aussi avoir recours aux instruments suivants de pr\u00e9vention de r\u00e9solution des controverses : tentative de conciliation aupr\u00e8s des services territoriaux de l\u2019Inspection nationale du travail ; coll\u00e8ges de conciliation et d\u2019arbitrage ; chambres d\u2019arbitrage institu\u00e9es aupr\u00e8s des organes de certification pr\u00e9vues par l\u2019article 76 du d\u00e9cret l\u00e9gislatif n\u00b0 276 de 2003.<\/p>\n\n\n\n<p>Le sch\u00e9ma du d\u00e9cret souligne en outre l\u2019interdiction du licenciement pour r\u00e9torsion, inflig\u00e9 par l\u2019employeur comme cons\u00e9quence des protestations l\u00e9gitimes du travailleur concernant le respect des obligations d\u2019information.<\/p>\n\n\n\n<p>Au cas o\u00f9 le travailleur voudrait saisir les juges du travail en d\u00e9clarant avoir subi un licenciement ou un traitement pr\u00e9judiciable comme r\u00e9torsion suite \u00e0 l\u2019exercice des droits pr\u00e9vus par ce d\u00e9cret, l\u2019employeur aura la charge de d\u00e9montrer que le licenciement ou les autres mesures ont \u00e9t\u00e9 inflig\u00e9s pour des motifs autres que la r\u00e9torsion.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur&nbsp;<a href=\"https:\/\/quotidianolavoro.ilsole24ore.com\/art\/contenzioso-e-giurisprudenza\/2022-07-22\/trasparenza-e-contratti-regole-evitare-contenzioso-165308.php?uuid=AEs0tLoB\">Il Quotidiano del Lavoro<\/a>&nbsp;de&nbsp;<strong>Il Sole 24 Ore<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Informations plus compl\u00e8tes.
