La premi\u00e8re disposition se r\u00e9f\u00e8re \u00e0 la dur\u00e9e maximum de la p\u00e9riode d\u2019essai (article 7) qui vient renforcer certains principes d\u00e9j\u00e0 \u00e9nonc\u00e9s par la jurisprudence en la mati\u00e8re. Notamment, la p\u00e9riode d\u2019essai ne peut avoir une dur\u00e9e sup\u00e9rieure \u00e0 six mois, \u00e0 moins que la convention collective appliqu\u00e9e au contrat ne pr\u00e9voie une dur\u00e9e inf\u00e9rieure. En cas de contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, la p\u00e9riode d\u2019essai doit \u00eatre proportionn\u00e9e \u00e0 la dur\u00e9e du contrat et aux fonctions attribu\u00e9es sur la base de la nature de l\u2019emploi. De plus, en cas de renouvellement du contrat pour l\u2019exercice des m\u00eames fonctions, une nouvelle p\u00e9riode d\u2019essai ne peut \u00eatre appliqu\u00e9e.<\/p>\n\n\n\n<p>Enfin, dans les hypoth\u00e8ses d\u2019\u00e9v\u00e9nements suspensifs (comme la maladie, l\u2019accident et les cong\u00e9s obligatoires) la dur\u00e9e de la p\u00e9riode d\u2019essai est suspendue et est prolong\u00e9e dans une mesure correspondant \u00e0 l\u2019absence du travailleur.<\/p>\n\n\n\n<p>Le d\u00e9cret pr\u00e9voit une nouveaut\u00e9 importante au sujet du cumul des emplois (article 8), avec la c\u00e9l\u00e8bre \u00ab clause d\u2019exclusivit\u00e9 \u00bb par laquelle l\u2019employeur interdit au salari\u00e9 d\u2019exercer une autre activit\u00e9 professionnelle. Le d\u00e9cret pr\u00e9voit en effet, pour la premi\u00e8re fois, l\u2019interdiction pour l\u2019employeur (et pour le commettant) d\u2019emp\u00eacher au travailleur d\u2019exercer une autre activit\u00e9 hors de l\u2019horaire de travail convenu ou de lui appliquer, pour cette raison, un traitement d\u00e9favorable. Font exception les hypoth\u00e8ses o\u00f9 le deuxi\u00e8me emploi \u00e9ventuel porterait pr\u00e9judice \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9 du travailleur (y compris le respect de la r\u00e9glementation sur les repos) ou porterait atteinte \u00e0 l\u2019int\u00e9grit\u00e9 du service public, ou encore constituerait un conflit d\u2019int\u00e9r\u00eats avec l\u2019activit\u00e9 principale (m\u00eame s\u2019il ne viole pas le devoir de fid\u00e9lit\u00e9).<\/p>\n\n\n\n<p>Une autre nouveaut\u00e9 concerne la pr\u00e9visibilit\u00e9 minimum du travail (article 9).
