En particulier, la lettre de licenciement, r\u00e9guli\u00e8rement distribu\u00e9e, a \u00e9t\u00e9 retir\u00e9e par la m\u00e8re du salari\u00e9, qui vivait avec lui, et qui a d\u00e9cid\u00e9 de ne pas lui remettre la lettre afin de le prot\u00e9ger d\u2019\u00e9ventuelles r\u00e9percussions psychologiques que la nouvelle du licenciement aurait pu provoquer. Par cons\u00e9quent, le salari\u00e9 a contest\u00e9 le licenciement apr\u00e8s l\u2019expiration du d\u00e9lai l\u00e9gal de 60 jours \u00e0 compter de la r\u00e9ception de la notification, invoquant, pour justifier le retard, le fait qu\u2019il n\u2019avait pas eu connaissance du licenciement.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/04\/shutterstock_1060957841-1024x683.jpg\" alt=\"\" class=\"wp-image-20196\"\/><\/figure>\n\n\n\n<p>Cependant, tant le tribunal de premi\u00e8re instance que la Cour d\u2019appel de Bologne (en deuxi\u00e8me instance) ont d\u00e9clar\u00e9 le recours irrecevable, en raison de l\u2019expiration du d\u00e9lai de contestation, consid\u00e9rant comme valable la notification re\u00e7ue \u00e0 l\u2019adresse du salari\u00e9. Ils ont reconnu l\u2019existence d\u2019une pr\u00e9somption l\u00e9gale de connaissance, fond\u00e9e sur l\u2019\u00e9quivalence juridique entre la connaissance effective et la possibilit\u00e9 de connaissance, en lien avec la r\u00e9ception d\u2019un acte au domicile du destinataire.<\/p>\n\n\n\n<p>La Cour de cassation a donc confirm\u00e9 cette interpr\u00e9tation, en r\u00e9affirmant que, selon le droit italien, il existe une pr\u00e9somption l\u00e9gale de connaissance des actes : un acte est consid\u00e9r\u00e9 comme connu d\u00e8s qu\u2019il parvient \u00e0 l\u2019adresse du destinataire. Cette pr\u00e9somption ne peut \u00eatre renvers\u00e9e que par des obstacles objectifs et ind\u00e9pendants de la volont\u00e9 du salari\u00e9, tels que des catastrophes naturelles, de graves dysfonctionnements postaux ou des absences prolong\u00e9es dues \u00e0 des cas de force majeure, mais non par des facteurs subjectifs propres au destinataire.<\/p>\n\n\n\n<p>En conclusion, l\u2019arr\u00eat r\u00e9affirme que, selon le droit italien, les d\u00e9lais pour contester un licenciement sont imp\u00e9ratifs et commencent \u00e0 courir d\u00e8s que la notification parvient \u00e0 l\u2019adresse du salari\u00e9, m\u00eame dans les cas o\u00f9 des \u00e9l\u00e9ments subjectifs emp\u00eachent le salari\u00e9 d\u2019avoir connaissance de la mesure disciplinaire prise \u00e0 son encontre.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par l\u2019ordonnance n\u00b0 15987 de 2025, la Cour de cassation italienne a \u00e9tabli que la notification du licenciement est r\u00e9put\u00e9e connue par le destinataire d\u00e8s qu\u2019elle est envoy\u00e9e \u00e0 son adresse de r\u00e9sidence, m\u00eame si le salari\u00e9 n\u2019en est pas effectivement inform\u00e9.
