{"id":26142,"date":"2025-10-02T07:50:28","date_gmt":"2025-10-02T05:50:28","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/licenziamento-congedo-parentale-2\/"},"modified":"2026-02-16T16:36:35","modified_gmt":"2026-02-16T15:36:35","slug":"licenziamento-congedo-parentale","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/licenciement-conge-parental\/","title":{"rendered":"Le licenciement est l\u00e9gitime lorsque le cong\u00e9 parental est utilis\u00e9 \u00e0 des fins \u00e9trang\u00e8res \u00e0 l\u2019assistance de l\u2019enfant (Camera di Commercio Italo-Francese &#8211; Vittorio De Luca, Silvia Zulato)"},"content":{"rendered":"\n<p>Par l\u2019ordonnance n\u00b0 24922 du 9 septembre 2025, la Cour de cassation italienne s\u2019est de nouveau prononc\u00e9e sur la d\u00e9licate question de l\u2019abus du cong\u00e9 parental, pr\u00e9vu par l\u2019article 32 du d\u00e9cret l\u00e9gislatif n\u00b0 151\/2001, en confirmant la l\u00e9gitimit\u00e9 du licenciement pour faute grave prononc\u00e9 \u00e0 l\u2019encontre d\u2019un salari\u00e9 qui avait utilis\u00e9 le cong\u00e9 \u00e0 des fins autres que la prise en charge de son enfant.<\/p>\n\n\n\n<p>L\u2019affaire trouve son origine dans le licenciement disciplinaire notifi\u00e9 par une soci\u00e9t\u00e9 \u00e0 l\u2019un de ses employ\u00e9s pour avoir abus\u00e9 du cong\u00e9 parental. La Cour d\u2019appel de Reggio Calabria (juridiction de second degr\u00e9), infirmant le jugement de premi\u00e8re instance, avait reconnu la l\u00e9gitimit\u00e9 de la rupture du contrat de travail, estimant \u00e9tabli que le salari\u00e9, durant la p\u00e9riode d\u2019absence, s\u2019\u00e9tait consacr\u00e9 \u00e0 des activit\u00e9s professionnelles au sein de l\u2019\u00e9tablissement baln\u00e9aire g\u00e9r\u00e9 par son \u00e9pouse, n\u00e9gligeant les soins directs \u00e0 ses enfants et, en particulier, \u00e0 l\u2019enfant de moins de trois ans. Une telle conduite, selon la Cour d\u2019appel, avait d\u00e9natur\u00e9 la finalit\u00e9 de l\u2019institution, rendant m\u00eame n\u00e9cessaire le recours \u00e0 une aide ext\u00e9rieure pour pallier son absence, en contradiction manifeste avec l\u2019objectif du cong\u00e9, destin\u00e9 \u00e0 favoriser la relation p\u00e8re-enfant.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"19555\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2024\/12\/shutterstock_1086225521-1024x684.jpg\" alt=\"\" class=\"wp-image-19555\"\/><\/figure>\n<\/figure>\n\n\n\n<p>Le salari\u00e9 avait soutenu que l\u2019abus de droit ne pouvait \u00eatre caract\u00e9ris\u00e9 qu\u2019en cas d\u2019activit\u00e9 continue et pr\u00e9pond\u00e9rante, tandis que ses pr\u00e9sences \u00e0 l\u2019\u00e9tablissement baln\u00e9aire \u00e0 des fins professionnelles avaient \u00e9t\u00e9 sporadiques et de courte dur\u00e9e. Les juges de la l\u00e9gitimit\u00e9 ont rejet\u00e9 une nouvelle fois cette th\u00e8se, pr\u00e9cisant que m\u00eame une utilisation occasionnelle du cong\u00e9 pour des finalit\u00e9s autres que l\u2019assistance \u00e0 l\u2019enfant constitue un abus de droit.<\/p>\n\n\n\n<p>La Cour de cassation italienne a en outre soulign\u00e9 que l\u2019exercice du cong\u00e9 parental doit respecter les principes de loyaut\u00e9 et de bonne foi contractuelle. L\u2019usage impropre de l\u2019institution porte pr\u00e9judice \u00e0 la fois \u00e0 l\u2019employeur, priv\u00e9 injustement de la prestation de travail, et \u00e0 l\u2019organisme de s\u00e9curit\u00e9 sociale, qui verse une indemnit\u00e9 d\u00e9tach\u00e9e de sa cause typique.<\/p>\n\n\n\n<p>En conclusion, l\u2019ordonnance confirme un principe d\u00e9j\u00e0 consolid\u00e9 dans la jurisprudence italienne: lorsque le lien de causalit\u00e9 entre l\u2019absence du travail et les soins \u00e0 l\u2019enfant fait d\u00e9faut, le cong\u00e9 parental est utilis\u00e9 de mani\u00e8re abusive.
