En d\u2019autres termes, l\u2019employeur doit inclure \u00e9galement les indemnit\u00e9s li\u00e9es aux fonctions exerc\u00e9es, d\u00e8s lors qu\u2019elles constituent un \u00e9l\u00e9ment stable et continu de la r\u00e9mun\u00e9ration.<\/p>\n\n\n\n<p>L\u2019affaire concernait un salari\u00e9 d\u2019une importante compagnie ferroviaire italienne, exer\u00e7ant les fonctions de train manager. Pendant les cong\u00e9s, l\u2019entreprise n\u2019avait pas inclus dans sa fiche de paie certaines rubriques telles que l\u2019indemnit\u00e9 de permanence \u00e0 bord, celle pour service hors district, l\u2019indemnit\u00e9 d\u2019efficience et les commissions. Le travailleur a donc demand\u00e9 le paiement des diff\u00e9rences de salaire, soutenant que ces sommes faisaient partie int\u00e9grante de sa r\u00e9mun\u00e9ration normale et auraient d\u00fb, \u00e0 ce titre, lui \u00eatre vers\u00e9es pendant les cong\u00e9s.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"20398\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/05\/shutterstock_1713676327-1024x608.jpg\" alt=\"\" class=\"wp-image-20398\"\/><\/figure>\n<\/figure>\n\n\n\n<p>La Cour d\u2019appel de Milan a reconnu le bien-fond\u00e9 des pr\u00e9tentions du salari\u00e9, consid\u00e9rant que ces indemnit\u00e9s \u00e9taient \u00e9troitement li\u00e9es aux fonctions exerc\u00e9es et que leur exclusion entra\u00eenait une r\u00e9duction injustifi\u00e9e du salaire pendant les cong\u00e9s, susceptible de dissuader le travailleur d\u2019en jouir pleinement. Selon les juges d\u2019appel, cette exclusion constituait une diminution injustifi\u00e9e du traitement \u00e9conomique durant la p\u00e9riode de cong\u00e9s, contraire au principe europ\u00e9en d\u2019\u00e9quivalence de la r\u00e9mun\u00e9ration et potentiellement dissuasive de l\u2019exercice effectif du droit au repos annuel.<\/p>\n\n\n\n<p>La Cour de cassation a confirm\u00e9 cette d\u00e9cision, se r\u00e9f\u00e9rant \u00e0 la Directive europ\u00e9enne 2003\/88\/CE et \u00e0 la jurisprudence de la Cour de justice de l\u2019Union europ\u00e9enne, selon lesquelles le droit \u00e0 des cong\u00e9s annuels pay\u00e9s constitue un principe fondamental du droit social europ\u00e9en. Par cons\u00e9quent, pendant la p\u00e9riode de repos, le travailleur doit percevoir une r\u00e9mun\u00e9ration \u00ab ordinaire \u00bb, incluant tous les \u00e9l\u00e9ments li\u00e9s de mani\u00e8re stable \u00e0 l\u2019ex\u00e9cution de son travail.<\/p>\n\n\n\n<p>La Haute Cour a \u00e9galement pr\u00e9cis\u00e9 qu\u2019une r\u00e9mun\u00e9ration r\u00e9duite pendant les cong\u00e9s peut constituer un \u00ab frein \u00e9conomique \u00bb, incitant les travailleurs \u00e0 renoncer \u00e0 leur droit au repos.
