D&rsquo;apr\u00e8s le juge du fond, le licenciement pour juste cause d\u00fb \u00e0 un mauvais rendement est l\u00e9gitimement configurable lorsque l&#8217;employeur d\u00e9montre : &#8211; qu&rsquo;il existe un \u00e9cart important entre les temps de travail prescrits et ceux r\u00e9ellement effectu\u00e9s par le travailleur ; &#8211; que la prestation rendue est inf\u00e9rieure \u00e0 l&rsquo;activit\u00e9 moyenne des autres employ\u00e9s accomplissant les m\u00eames t\u00e2ches.
