conform\u00e9ment aux d\u00e9cisions du tribunal de premier degr\u00e9 &#8211; n\u2019avait reconnu au travailleur que la protection indemnitaire, excluant que le non-respect du d\u00e9lai pr\u00e9vu par la convention collective pouvait entra\u00eener l&rsquo;annulation du licenciement donnant lieu \u00e0 une r\u00e9int\u00e9gration.<\/p>\n\n\n\n<p>En accueillant le recours du travailleur invoquant une application incorrecte et fausse de la loi portant sur la non-reconnaissance de la r\u00e9int\u00e9gration d\u00e9rivant du non-respect du d\u00e9lai, la Cour de Cassation &#8211; dans la d\u00e9cision comment\u00e9e &#8211; a cass\u00e9 le jugement au fond estimant que la violation de la r\u00e8gle relative au d\u00e9lai pour l&rsquo;adoption de la mesure disciplinaire impliquait l&rsquo;acceptation des justifications et, par cons\u00e9quent, l&rsquo;applicabilit\u00e9 de la protection r\u00e9elle conform\u00e9ment \u00e0 l\u2019art. 18, 4e alin\u00e9a, du Statut des Travailleurs, comportant le droit \u00e0 la r\u00e9int\u00e9gration de l&rsquo;int\u00e9ress\u00e9.<\/p>\n\n\n\n<p>Les juges de la Cour de Cassation ont notamment soulign\u00e9 que \u2039\u2039&nbsp;selon les dispositions de l&rsquo;art. 21, n\u00b02, 3e alin\u00e9a, de la Convention collective Gaz et Eau, des cons\u00e9quences diff\u00e9rentes de celles de l&rsquo;obligation de proc\u00e9der \u00e0 l\u2019activit\u00e9 sp\u00e9cifique indiqu\u00e9e dans le d\u00e9lai fix\u00e9 et de la \u00ab&nbsp;fictio&nbsp;\u00bb de l\u2019acceptation intervenue des justifications en cas de non-respect de l\u2019obligation pr\u00e9cit\u00e9e ne semblent pas concevables&nbsp;\u203a\u203a.<\/p>\n\n\n\n<p>En effet, la formulation de la r\u00e8gle de n\u00e9gociation collective (r\u00e9currente, en effet, dans les principales conventions collectives du secteur priv\u00e9) est claire, en pr\u00e9voyant, pass\u00e9 le d\u00e9lai fix\u00e9, que les justifications du travailleur doivent \u00eatre estim\u00e9es favorablement accueillies par son employeur, et la Cour de Cassation a donc mis l\u2019accent sur le fait que le licenciement \u2039\u2039&nbsp;devait donc \u00eatre consid\u00e9r\u00e9 pas simplement inefficace pour cause de non-respect d&rsquo;un d\u00e9lai proc\u00e9dural (au m\u00eame titre que l&rsquo;inad\u00e9quation de la contestation faisant l\u2019objet de la d\u00e9cision de cette Cour, \u00e0 chambres r\u00e9unies, n\u00b0 30985 du 27 d\u00e9cembre 2017)\u2026 mais ill\u00e9gitime pour inexistence du fait contest\u00e9, l\u2019employeur ayant accueilli les justifications \u00e0 la d\u00e9charge de l&#8217;employ\u00e9 et donc pour l\u2019absence totale d&rsquo;un \u00e9l\u00e9ment essentiel de la juste cause&nbsp;\u203a\u203a.<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>Cliquez <a href=\"http:\/\/quotidianolavoro.ilsole24ore.com\/art\/contenzioso-e-giurisprudenza\/2018-09-13\/il-licenziamento-oltre-termine-previsto-ccnl-comporta-reintegra-112209.php?uuid=AE6tvgrF\"><strong>ici<\/strong><\/a> pour continuer \u00e0 lire la note du jugement prononc\u00e9 publi\u00e9e sur Il Quotidiano del Lavoro de Il Sole 24 Ore.<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par son arr\u00eat n\u00b0 21569 du 3 septembre 2018, la Cour de Cassation italienne est intervenue sur les cons\u00e9quences d\u2019un licenciement disciplinaire inflig\u00e9 apr\u00e8s l&rsquo;expiration du d\u00e9lai pr\u00e9vu par la convention collective.
