Tel est le principe de droit que la <a href=\"http:\/\/www.unicolavoro.ilsole24ore.com\/ExternalDefault.aspx?idDoc=32998607&amp;idDocType=3\">Cour de cassation italienne a affirm\u00e9 le 3 d\u00e9cembre dernier en rendant son arr\u00eat n\u00b0 31155\/2018.<\/a><\/p>\n\n\n\n<p>L&rsquo;affaire analys\u00e9e trouve son origine dans le licenciement disciplinaire d&rsquo;un salari\u00e9 qui avait menac\u00e9 de mort son sup\u00e9rieur&nbsp;; ce, non pas dans le contexte d&rsquo;une conversation anim\u00e9e, mais dans le cadre d&rsquo;un rapport de travail conflictuel, par ailleurs d\u00e9j\u00e0 constat\u00e9 \u00e0 plusieurs reprises par les autorit\u00e9s judiciaires.<\/p>\n\n\n\n<p>R\u00e9formant la d\u00e9cision rendue par le tribunal du Capitole en 2016, la Cour d&rsquo;appel de Rome avait annul\u00e9 le licenciement, ordonnant \u00e0 l&rsquo;entreprise de r\u00e9int\u00e9grer le salari\u00e9, estimant qu&rsquo;il n&rsquo;y avait pas de motif de licenciement \u00e9tant donn\u00e9 que les propos tenus par le travailleur ne remplissaient pas les conditions minimales de gravit\u00e9 suffisantes pour \u00eatre consid\u00e9r\u00e9s comme susceptibles de briser le lien de confiance entre les parties.<\/p>\n\n\n\n<p>L&#8217;employeur a fait appel de cette d\u00e9cision devant la Cour de cassation, d\u00e9non\u00e7ant la violation et l&rsquo;application erron\u00e9e de la loi, la Cour ayant commis une erreur en estimant que les faits \u00e9taient sans fondement.
