La Cour de cassation s&rsquo;est exprim\u00e9e en ces termes dans son <a href=\"http:\/\/www.unicolavoro.ilsole24ore.com\/ExternalDefault.aspx?idProvv=3675037&amp;idDocType=3&amp;mode=1\">ordonnance n\u00b029402 du 15 novembre 2018<\/a>.<\/p>\n\n\n\n<p>L&rsquo;affaire s&rsquo;appuie sur l&rsquo;appel contre un licenciement ordonn\u00e9 pour d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie pr\u00e9vue par la convention collective, non pas dans l&rsquo;imm\u00e9diatet\u00e9 de l&rsquo;\u00e9v\u00e9nement, mais apr\u00e8s quatre mois \u00e0 compter de celui-ci. Selon le juge des r\u00e9f\u00e9r\u00e9s, le licenciement devait \u00eatre consid\u00e9r\u00e9 comme l\u00e9gitime, compte tenu de la particularit\u00e9 du type de licenciement, n&rsquo;ayant pas un caract\u00e8re disciplinaire. Cependant, la Cour d&rsquo;appel de Lecce, saisie en appel, adoptait une position diff\u00e9rente et annulait la disposition de l&rsquo;entreprise qui avait effectivement accueilli l&rsquo;exception de tardivet\u00e9 soulev\u00e9e par le requ\u00e9rant. En effet, la Cour territoriale observait que le retard de l&#8217;employeur avait d\u00e9termin\u00e9 l&rsquo;attente l\u00e9gitime de la travailleuse sur la possibilit\u00e9 de continuation de la relation de travail, m\u00eame pass\u00e9 un certain d\u00e9lai \u00e0 compter du d\u00e9but de sa suspension pour cause de maladie.<\/p>\n\n\n\n<p>La Soci\u00e9t\u00e9 a donc form\u00e9 un pourvoi aupr\u00e8s de la Cour de cassation contre le jugement, s&rsquo;opposant ainsi \u00e0 l&rsquo;application erron\u00e9e de la loi par les juges d&rsquo;appel.<\/p>\n\n\n\n<p>Charg\u00e9e de l&rsquo;affaire, la Cour de cassation a partag\u00e9 l&rsquo;interpr\u00e9tation donn\u00e9e au moment de l&rsquo;appel, confirmant que le licenciement pour d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie doit \u00eatre adopt\u00e9 dans l\u2019imm\u00e9diatet\u00e9 de l&rsquo;\u00e9v\u00e9nement, car une attente, du point de vue des faits concluants, pourrait g\u00e9n\u00e9rer une attente l\u00e9gitime sur la \u00ab stabilisation de la relation de travail \u00bb m\u00eame apr\u00e8s la fin du cong\u00e9 maladie, en excluant la l\u00e9gitimit\u00e9 de tout licenciement.<\/p>\n\n\n\n<p>En particulier, afin de r\u00e9soudre l&rsquo;affaire, la Cour de cassation se r\u00e9f\u00e8re au jugement n\u00b0194\/2010, prononc\u00e9 par la m\u00eame Cour territoriale, qui affirmait la n\u00e9cessit\u00e9 que le crit\u00e8re de rapidit\u00e9 soit \u00e9galement appliqu\u00e9 en cas de licenciement pour d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie, un crit\u00e8re dans tous les cas \u00ab \u00e0 comparer non seulement \u00e0 une donn\u00e9e strictement chronologique, mais aussi \u00e0 une r\u00e9f\u00e9rence \u00e0 l&rsquo;ensemble du contexte des circonstances utiles pour \u00e9valuer le comportement de l&rsquo;entreprise vis-\u00e0-vis de la volont\u00e9 ou non de la r\u00e9solution \u00bb.<\/p>\n\n\n\n<p>La d\u00e9cision en question s&rsquo;aligne sur une orientation jurisprudentielle consolid\u00e9e de la part de la Cour de cassation qui a r\u00e9affirm\u00e9 \u00e0 de nombreuses reprises l&rsquo;ill\u00e9gitimit\u00e9 du licenciement ordonn\u00e9 pass\u00e9 un long d\u00e9lai \u00e0 compter de la p\u00e9riode de cong\u00e9 maladie, ayant constat\u00e9 que le passage d&rsquo;une p\u00e9riode de temps consid\u00e9rable autre ne fait que concr\u00e9tiser la volont\u00e9 abdicative de l&#8217;employeur (Cassation Civile, Section du Travail n\u00b025535\/2018).<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>Lisez <a href=\"http:\/\/quotidianolavoro.ilsole24ore.com\/art\/contenzioso-e-giurisprudenza\/2018-11-30\/il-licenziamento-comporto-deve-essere-tempestivo-152517.php?uuid=AE2x0QqG&amp;refresh_ce=1\">ici<\/a> la version compl\u00e8te de l&rsquo;article.<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le licenciement ordonn\u00e9 pour d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie doit \u00eatre notifi\u00e9 sans d\u00e9lai.
