{"id":26400,"date":"2019-07-17T22:00:00","date_gmt":"2019-07-17T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/demission-annulee-arrieres-de-salaire-dus-des-lintroduction-de-laction-il-quotidiano-del-lavoro-de-il-sole-24-ore-17-juillet-2019-alberto-de-luca-antonella-iacobellis\/"},"modified":"2026-02-16T16:26:04","modified_gmt":"2026-02-16T15:26:04","slug":"demission-annulee-arrieres-de-salaire-dus-des-lintroduction-de-laction-il-quotidiano-del-lavoro-de-il-sole-24-ore-17-juillet-2019-alberto-de-luca-antonella-iacobellis","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/demission-annulee-arrieres-de-salaire-dus-des-lintroduction-de-laction-il-quotidiano-del-lavoro-de-il-sole-24-ore-17-juillet-2019-alberto-de-luca-antonella-iacobellis\/","title":{"rendered":"D\u00e9mission annul\u00e9e, arri\u00e9r\u00e9s de salaire dus d\u00e8s l&rsquo;introduction de l&rsquo;action (Il Quotidiano del Lavoro de Il Sole 24 Ore, 17 juillet 2019 \u2013 Alberto De Luca, Antonella Iacobellis)"},"content":{"rendered":"\n<p><span lang=\"FR\">La Cour de cassation italienne, dans son arr\u00eat n\u00b0 16998 du 25 juin 2019, s&rsquo;est pench\u00e9e \u00e0 nouveau sur la question des effets du jugement annulant la d\u00e9mission aux fins de la r\u00e9mun\u00e9ration due pour la p\u00e9riode comprise entre la d\u00e9mission annul\u00e9e et le prononc\u00e9 dudit jugement. <\/span><\/p>\n\n\n\n<p><span lang=\"FR\">L&rsquo;affaire trouve son origine dans l&rsquo;action en annulation de la d\u00e9mission intent\u00e9e par un salari\u00e9, qui pr\u00e9tendait avoir agi dans un \u00e9tat d&rsquo;incapacit\u00e9 de comprendre et de volont\u00e9.<\/span><\/p>\n\n\n\n<p><span lang=\"FR\">Dans le cadre de la proc\u00e9dure au fond, la d\u00e9mission a d&rsquo;abord \u00e9t\u00e9 confirm\u00e9e en premi\u00e8re instance, puis finalement annul\u00e9e par la Cour d&rsquo;appel de Palerme, qui, faisant droit \u00e0 la demande du salari\u00e9, a confirm\u00e9 son droit aux arri\u00e9r\u00e9s sur salaire, avec effet \u00e0 la date de la demande en justice.<\/span><\/p>\n\n\n\n<p><span lang=\"FR\">Se pourvoyant en cassation \u00e0 l&rsquo;encontre d&rsquo;une telle d\u00e9cision, l&#8217;employeur a invoqu\u00e9 (parmi d&rsquo;autres moyens) l&rsquo;application erron\u00e9e ou fausse d&rsquo;un principe du droit, soutenant que dans la mesure o\u00f9 le salari\u00e9 n&rsquo;avait pas fourni le service apr\u00e8s sa d\u00e9mission, qu&rsquo;il a remise en cause, par la suite, en droit, les juges du fond auraient d\u00fb limiter la condamnation au versement des salaires correspondant uniquement \u00e0 la p\u00e9riode suivant le jugement.<\/span><\/p>\n\n\n\n<p><span lang=\"FR\">L&rsquo;objet principal de l&rsquo;examen de la l\u00e9galit\u00e9 est donc l&rsquo;identification du moment \u00e0 partir duquel le droit aux diff\u00e9rences de r\u00e9mun\u00e9ration pour le travailleur doit d\u00e9buter.<\/span><\/p>\n\n\n\n<p><span lang=\"FR\">En examinant les orientations jurisprudentielles dans ce domaine, la Cour a identifi\u00e9 deux tendances. Une premi\u00e8re tendance, non contest\u00e9e, selon laquelle pour l&rsquo;ex\u00e9cution de l&rsquo;obligation de payer il s&rsquo;av\u00e8re n\u00e9cessaire que le salari\u00e9 mette \u00e0 disposition ses services et, seulement \u00e0 titre exceptionnel et en vertu d&rsquo;une disposition expresse de la loi (maladie ou licenciement injustifi\u00e9 sous le r\u00e9gime de la protection r\u00e9elle), le paiement du salaire peut \u00eatre reconnu m\u00eame en l&rsquo;absence de la prestation. Une seconde tendance, qui fait, quant \u00e0 elle, l&rsquo;objet d&rsquo;un d\u00e9bat, concerne l&rsquo;identification du moment \u00e0 partir duquel, une fois obtenu le prononc\u00e9 de la d\u00e9cision judiciaire portant annulation de la d\u00e9mission, le salari\u00e9 a droit aux diff\u00e9rences de salaire \u00e9chues : le moment de l&rsquo;introduction de l&rsquo;action en justice (Cass. n\u00b0 8886, 14 avril 2010, Cass. n\u00b0 4232, 13 f\u00e9vrier 2019,) ou \u00e0 partir de la date du jugement (Cass. n\u00b0 22063, 17 octobre 2014, Cass. n\u00b0 21701, 6 septembre 2018). <\/span><\/p>\n\n\n\n<p><span lang=\"FR\">Par cet arr\u00eat, la Cour supr\u00eame a confirm\u00e9 le point de vue selon lequel le droit \u00e0 la r\u00e9mun\u00e9ration na\u00eet \u00e0 partir du moment o\u00f9 l&rsquo;action en annulation de la d\u00e9mission est introduite (le moment o\u00f9 la d\u00e9mission est contest\u00e9e et de la mise en demeure de payer de l&#8217;employeur conform\u00e9ment \u00e0 l&rsquo;article 1226 du Code civil italien), \u00e9tant donn\u00e9 le principe selon lequel la dur\u00e9e de la proc\u00e9dure ne doit pas porter pr\u00e9judice \u00e0 la partie qui l&#8217;emporte. <\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation italienne, dans son arr\u00eat n\u00b0 16998 du 25 juin 2019, s&rsquo;est pench\u00e9e \u00e0 nouveau sur la question des effets du jugement annulant la d\u00e9mission aux fins de la r\u00e9mun\u00e9ration due pour la p\u00e9riode comprise entre la d\u00e9mission annul\u00e9e et le prononc\u00e9 dudit jugement.
