{"id":26408,"date":"2015-05-31T22:00:00","date_gmt":"2015-05-31T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/la-compromission-des-relations-avec-les-clients-justifie-le-licenciement\/"},"modified":"2026-02-16T16:26:05","modified_gmt":"2026-02-16T15:26:05","slug":"la-compromission-des-relations-avec-les-clients-justifie-le-licenciement","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/giurisprudenza\/la-compromission-des-relations-avec-les-clients-justifie-le-licenciement\/","title":{"rendered":"La compromission des relations avec les clients justifie le licenciement."},"content":{"rendered":"\n<p>Le Tribunal de Milan, Section Travail, par sentence du 30\u00a0avril 2015, a statu\u00e9 dans une affaire intent\u00e9e par un dirigeant qui contestait le licenciement pour juste cause intim\u00e9 \u00e0 l&rsquo;issue d&rsquo;une proc\u00e9dure disciplinaire engag\u00e9e par l&#8217;employeur (par ex. une soci\u00e9t\u00e9 de gestion d&rsquo;\u00e9pargne) selon laquelle le dirigeant a gravement compromis les relations avec les investisseurs des fonds de placement g\u00e9r\u00e9s.<br \/> Dans son recours, en ordre principal, le dirigeant a demand\u00e9 au juge de d\u00e9clarer la nullit\u00e9 de l&rsquo;acte d&rsquo;expulsion puisqu&rsquo;il a \u00e9t\u00e9 ordonn\u00e9 par repr\u00e9sailles, d&rsquo;en v\u00e9rifier le caract\u00e8re injurieux et de condamner la soci\u00e9t\u00e9 employant \u00e0 sa r\u00e9int\u00e9gration, au paiement de la r\u00e9tribution acquise par le licenciement \u00e0 la r\u00e9int\u00e9gration, ainsi qu&rsquo;\u00e0 la r\u00e9paration des dommages professionnels et non patrimoniaux.<br \/> En ordre accessoire, en revanche, le dirigeant a demand\u00e9 la condamnation de l&#8217;employeur au paiement du pr\u00e9avis et de l&rsquo;indemnit\u00e9 suppl\u00e9mentaire pr\u00e9vue par la Convention collective nationale de travail (CCNL) des dirigeants appliqu\u00e9e \u00e0 la relation de travail.<br \/>Pour soutenir sa th\u00e8se, le dirigeant a \u00e9galement affirm\u00e9 que le licenciement \u00e9tait ill\u00e9gitime en raison de l&rsquo;aboutissement des faits contest\u00e9s aux pr\u00e9rogatives du Conseil d&rsquo;administration de la soci\u00e9t\u00e9 employant (sp\u00e9cifiquement aux fonctions d&rsquo;administrateur d\u00e9l\u00e9gu\u00e9 remplies par celui-ci) et non \u00e0 celles du dirigeant.<br \/>La Soci\u00e9t\u00e9 a en revanche soutenu que les contestations formul\u00e9es au dirigeant \u00e9taient sp\u00e9cifiques, imm\u00e9diates et li\u00e9es aussi bien aux pr\u00e9rogatives de l&rsquo;administrateur d\u00e9l\u00e9gu\u00e9 qu&rsquo;\u00e0 celles du dirigeant.<br \/>Le Juge a rejet\u00e9 le recours, estimant que toutes les objections soulev\u00e9es envers le dirigeant \u00e9taient prouv\u00e9es et suffisamment graves pour emp\u00eacher la poursuite de la relation.<br \/>Le Juge a \u00e9galement pris position concernant les d\u00e9ductions du dirigeant li\u00e9es \u00e0 l&rsquo;aff\u00e9rence des faits contest\u00e9s aux pr\u00e9rogatives du Conseil d&rsquo;administration de la soci\u00e9t\u00e9 employant et non pas \u00e0 celles du dirigeant.<br \/>Sur ce point, le Juge a d\u00e9clar\u00e9 que, bien que les faits qui sous-tendent les diverses contestations puissent en partie co\u00efncider (ndlr avec les fonctions d&rsquo;Administrateur d\u00e9l\u00e9gu\u00e9 et la position de dirigeant), ils \u00e9taient toutefois \u00e9valu\u00e9s uniquement du point de vue du droit du travail puis compar\u00e9s \u00e0 la d\u00e9pr\u00e9ciation \u00e9ventuelle du lien de confiance que la commission des comportements contest\u00e9s avait d\u00e9termin\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le Tribunal de Milan, Section Travail, par sentence du 30\u00a0avril 2015, a statu\u00e9 dans une affaire intent\u00e9e par un dirigeant qui contestait le licenciement pour juste cause intim\u00e9 \u00e0 l&rsquo;issue d&rsquo;une proc\u00e9dure disciplinaire engag\u00e9e par l&#8217;employeur (par ex. une soci\u00e9t\u00e9 de gestion d&rsquo;\u00e9pargne) selon laquelle le dirigeant a gravement compromis les relations avec les investisseurs [&hellip;]<\/p>\n","protected":false},"author":5,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[190],"tags":[],"class_list":["post-26408","post","type-post","status-publish","format-standard","hentry","category-insights"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>La compromission des relations avec les clients justifie le licenciement. - De Luca &amp;
