Dans le cas d\u2019esp\u00e8ce, le travailleur, d\u2019abord sanctionn\u00e9, puis licenci\u00e9, a form\u00e9 un recours en cassation en affirmant que (i) la photocopie des documents de l\u2019entreprise \u00e9tait n\u00e9cessaire \u00e0 sa d\u00e9fense puisqu\u2019il a longtemps \u00e9t\u00e9 d\u00e9qualifi\u00e9 (ii) il ne s\u2019agissait pas d\u2019un document confidentiel, et en tout cas que (iii) l\u2019objectif de prot\u00e9ger ses droits doit pr\u00e9valoir sur le devoir de confidentialit\u00e9. Selon la Cour de cassation, ce motif ne peut pas \u00eatre consid\u00e9r\u00e9 comme fond\u00e9 vu que \u00ab\u00a0<em>m\u00eame<\/em> <em>les t\u00e9moignages<\/em>\u00a0\u00bb ont r\u00e9v\u00e9l\u00e9 qu\u2019il ne s\u2019agissait pas \u00ab\u00a0<em>seulement de documents confidentiels de l\u2019entreprise\u00a0<\/em>\u00bb mais \u00ab\u00a0<strong><em>d\u2019instructions qui contenaient des informations sp\u00e9cifiques <\/em><\/strong><em>relatives au type de mat\u00e9riaux utilis\u00e9s<strong>, <\/strong>aux<strong> proc\u00e9dures et <\/strong>aux<strong> instruments <\/strong>utilis\u00e9s<strong> (&#8230;) un v\u00e9ritable savoir-faire de l\u2019entreprise <\/strong>dont la<strong> confidentialit\u00e9 <\/strong>appara\u00eet renforc\u00e9e par l\u2019exigence de ne pas diffuser \u00e0 des tiers (parmi lesquelles il pourrait y avoir des personnes concurrentes) <strong>des connaissances importantes pour la production\u00a0\u00bb<\/strong><\/em><strong>. <\/strong>Selon la Cour, donc, l\u2019important n\u2019est pas \u00ab\u00a0<em>le devoir g\u00e9n\u00e9ral de ne pas divulguer des documents d\u2019entreprise, mais une <strong>obligation sp\u00e9cifique \u00e0 garder des documents confidentiels<\/strong> qui concernent \u00e9galement des aspects importants et significatifs de l\u2019organisation de la production de l\u2019employeur\u00a0\u00bb.<\/em> Documents que le travailleur aurait par ailleurs pu se procurer en introduisant une requ\u00eate au juge en charge de l\u2019affaire conform\u00e9ment \u00e0 l\u2019article 210 du code de proc\u00e9dure civile.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son arr\u00eat no12804 du 22 mai 2017, a affirm\u00e9 que le salari\u00e9 qui photocopie des documents comportant le savoir-faire de l\u2019entreprise peut faire l\u2019objet d\u2019une sanction disciplinaire, m\u00eame si cette activit\u00e9 a pour but de prot\u00e9ger ses droits en justice.
