Dans le cas d\u2019esp\u00e8ce, un salari\u00e9, en qualit\u00e9 de technicien joignable et responsable des urgences, \u00e9tait licenci\u00e9 \u00e0 l\u2019issue d\u2019une proc\u00e9dure disciplinaire pour avoir refus\u00e9 d\u2019intervenir lors de deux demandes successives d\u2019intervention pour une baisse de pression et une fuite de gaz. Le travailleur avait saisi le tribunal de premi\u00e8re instance pour qu\u2019il d\u00e9clare le licenciement ill\u00e9gal, mais s\u2019\u00e9tait vu rejeter sa requ\u00eate. Celui-ci avait donc interjet\u00e9 appel. La Cour territorialement comp\u00e9tente, en reformant totalement la d\u00e9cision du tribunal, avait d\u00e9clar\u00e9 le licenciement ill\u00e9gal et condamnait l\u2019employeur \u00e0 r\u00e9int\u00e9grer le travailleur \u00e0 son poste. La Cour a estim\u00e9 en effet que les faits reproch\u00e9s au salari\u00e9 faisaient partie de ceux que la CCNL, dans le cadre de la relation de travail, sanctionnait par une sanction conservatoire s\u2019il n\u2019y avait pas r\u00e9cidive. L\u2019employeur a form\u00e9 un recours en cassation contre la d\u00e9cision de la Cour territorialement comp\u00e9tente. Les juges de la Cour de cassation ont clarifi\u00e9 que dans la d\u00e9cision en objet, le juge du fond doit s\u2019assurer que les <strong>dispositions collectives<\/strong> disciplinaires sont en ad\u00e9quation avec ce que pr\u00e9voit <strong>l\u2019article 2016 du code civil<\/strong> et relever la <strong>nullit\u00e9<\/strong> de celles qui consid\u00e8rent comme <strong>juste cause ou comme motif justifi\u00e9 de licenciement,<\/strong> <strong>des conduites qui par leur nature sont sujettes seulement \u00e0 d\u2019\u00e9ventuelles sanctions conservatoires<\/strong>. Toujours selon la Cour supr\u00eame, le juge du fond ne peut au contraire pas faire l\u2019inverse, \u00e0 savoir \u00e9tendre la liste des fautes graves ou des motifs justifi\u00e9s de licenciement au-del\u00e0 de ce que l\u2019autonomie des parties a \u00e9tabli. Partant de cette base, la Cour de cassation a statu\u00e9 qu\u2019en mati\u00e8re disciplinaire, il faut de toute fa\u00e7on \u00e9valuer la <strong>gravit\u00e9 de l\u2019infraction sous l\u2019angle objectif et subjectif<\/strong> ainsi que sous celui de la <strong>fiabilit\u00e9 future<\/strong> du travailleur au regard de la prestation d\u00e9coulant du contrat.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, dans son arr\u00eat no 7166 du 21 mars 2017, aborde une nouvelle fois le th\u00e8me du licenciement disciplinaire.
