En l\u2019esp\u00e8ce, la Cour a rejet\u00e9 le recours d\u2019un salari\u00e9 de Trenitalia qui avait \u00e9t\u00e9 licenci\u00e9 pour s\u2019\u00eatre servi de mani\u00e8re ill\u00e9gale de 238 billets d\u00e9j\u00e0 utilis\u00e9s en vue de les revendre ou effectuer des op\u00e9rations de remboursement illicites. Parmi les moyens de recours invoqu\u00e9s par le travailleur figurait le non-respect du d\u00e9lai de notification de l\u2019avertissement, vu qu\u2019il a \u00e9t\u00e9 d\u00e9cid\u00e9 60 jours apr\u00e8s la cl\u00f4ture des travaux de la premi\u00e8re commission d\u2019enqu\u00eate mandat\u00e9e par la soci\u00e9t\u00e9 et, de toute fa\u00e7on, apr\u00e8s qu\u2019onze mois s\u2019\u00e9taient \u00e9coul\u00e9s depuis qu\u2019il avait commis les faits reproch\u00e9s. Dans les motifs de l\u2019arr\u00eat, la Cour a estim\u00e9 que le temps consacr\u00e9 aux v\u00e9rifications pr\u00e9c\u00e9dant l\u2019ouverture de la proc\u00e9dure a \u00e9t\u00e9 dict\u00e9 par les contr\u00f4les complexes et n\u00e9cessaires effectu\u00e9s par la soci\u00e9t\u00e9, exigeant au moins deux commissions d\u2019enqu\u00eate. En particulier, l\u2019avertissement a \u00e9t\u00e9 notifi\u00e9 au travailleur vingt jours apr\u00e8s que la seconde commission se soit prononc\u00e9e, \u00e0 savoir dans un d\u00e9lai ad\u00e9quat et en tout cas respectueux du d\u00e9lai de 30 jours exig\u00e9 par la CCNL en vigueur. La Cour de cassation, dans le m\u00eame prononc\u00e9, rappelant une de ses pr\u00e9c\u00e9dentes d\u00e9cisions jurisprudentielles, a \u00e9galement observ\u00e9 que \u00ab\u00a0<em>bien que l\u2019article 7 de la loi n<sup>o<\/sup> 300\/1970 <strong>ne<\/strong> pr\u00e9voit pas l\u2019<strong>obligation<\/strong> pour l\u2019employeur de mettre <strong>spontan\u00e9ment \u00e0 disposition<\/strong> du travailleur la documentation sur laquelle se fonde l\u2019avertissement disciplinaire, il doit n\u00e9anmoins,<strong> lorsque l\u2019inculp\u00e9 en fait la demande<\/strong> et que l\u2019examen des documents est n\u00e9cessaire pour une d\u00e9fense ad\u00e9quate, lui offrir la possibilit\u00e9 de la visualiser en s\u2019appuyant sur le principe du comportement correct et de bonne foi dans l\u2019ex\u00e9cution du contrat<\/em> \u00bb.
